Each bid must be prepared and submitted in accordance with the Instructions to Bidders and must be accompanied by Bid Security in the form ofa certified check, bank check, or bid bond in the amount often percent (10%) ofthe total amount ofthe bid. No later than forty-five (45) days after the bid opening, the Municipality shall accept bids or reject all bids. After the bid opening, a bid may not be withdrawn prior to the date that is forty-five (45) days after such bid opening. The Municipality reserves the right to reject any or all bids, and advertise for new bids, if in its opinion the best interest ofthe Municipality will hereby be promoted. No bid will be considered from any person who is in arrears to the City, or who is in default as surety or otherwise upon any obligation to the City, nor shall a bid be considered from any contractor whose performance on any previous contract with the City has been unsatisfactoiy in the opinion ofthe City Council. A contractor whose performance has been unsatisfactory shall not be deemed a responsible qualified bidder. The successful bidder will be required to furnish a Performance Bond and a Payment Bond in the statutory form of public bonds required by Section 137 of the State Finance Law, each for one hundred percent (100%) ofthe amount ofthe Contract Please note that there is a 10% MWBE participation requirement for this project. Liquidated damages will be assessed for each day of delay ofthe contract in the amount of one thousand ($1,000.00) dollars per calendar day The City reserves the right to reject any and all bids received, to waive informalities and also reserves the right to increase, decrease, omit any portions ofthe Specification. The City will award the Contract to the lowest responsible bidder qualified by past experience to satisfactorily perform the required work ofthis contract and furnishing the required security. Any Contractor submitting a bid must be able to proceed with the detailed work immediately upon Notification to Proceed and must complete all work within the project duration indicated.
