In the event of a dispute with respect to any term or condition in the Contract Documents, they shall be interpreted in the following order: this Contract, the Request for Bids, and the Vendor's Bids.The City of Dubuque is exempt from sales tax and certain other use taxes. Any charges for taxes from which the City is exempt will be deducted from invoices before payment is made.Deicer salt, in specified quantity, must be delivered, no later than November 1, 2022. Failure to respond in the designated time period may result in the City holding the Vendor in breach of contract and liquidated damages will apply. Liquidated damages of $1000 per calendar day will be assessed against the Contract balance for each and every day the purchase agreement remains incomplete.The City of Dubuque, Iowa, reserves the right to reject any and all Bids. The City is not responsible for delays occasioned by the U.S. Postal Service, the internal mail delivery system of the City, or any other means of delivery employed by the bidder. Similarly, the City is not responsible for, and will not open, any bid responses that are received after the time stated above. Late submittals will be retained in the RFB file, unopened. No responsibility will be attached to any person for premature opening of a bid not properly identified.
