Latest date/time for submittal of pre-bid inquiries 4:00 PM Tuesday, May 24, 2022 Submit Pre-Bid Inquiries to: jaysonb@klassencorp.com Bid Security. Each Bid Proposal shall be accompanied by Bid Security in an amount equal to ten percent (10%) of the maximum amount of the Bid Proposal, inclusive of the proposed price for any additive Alternate Bid Item(s). Bid Security shall be in the form of: (i) cash; (ii) cashier or certified check payable to the dis; or (iii) bid bond, in the form and content set forth in the Contract Documents. Failure of any Bid Proposal to be accompanied by Bid Security in the form and in the amount required shall render such Bid Proposal to be non-responsive and rejected by the District. Contractor's License Classification. Pursuant to Public Contract Code 3300, the District requires that Bidders possess the following classification(s) of California Contractors License at the time the Bid Proposal is submitted and at time that the Contract for the Work is awarded: B - General Building Contractor. Bidder and Subcontractors DIR Registered Contractor Status. Bidders must be a DIR Registered Contractor when submitting a Bid Proposal. The Bid Proposal of a Bidder who is not a DIR Registered Contractor when the Bid Proposal is submitted will be rejected for non-responsiveness. All Subcontractors identified in a Bidder's Subcontractors' List must be DIR Registered contractors at the time the Bid Proposal is submitted. Pre-Bid Inquiries. Bidders are solely and exclusively responsible for submitting Pre-Bid Inquiries before the latest date/time for submitting Pre-Bid Inquiries. The District will not respond to Pre-Bid Inquiries submitted after the date/time stated above. Failure to request interpretation or clarification of any portion of the Contract Documents pursuant to the foregoing is a waiver of any discrepancy, defect or conflict therein. Duration of Bid Proposals. Bid Proposals shall not be withdrawn by any Bidder for a period of sixty (60) days after the opening of Bid Proposals. During this time, all Bidders shall guarantee prices quoted in their respective Bid Proposals. Job-Walk; Bidders List. If the Job Walk is mandatory, the District will establish the Bidders List consisting of the Bidders attending the entire Mandatory Job Walk. Bid Proposals submitted by Bidders who are not on the Bidders List will be rejected by the District as being nonresponsive. If the Job Walk is not mandatory, the District will establish the Bidders List based on Bidders who have obtained the Bid and Contract Documents from ASAP Reprographics. Waiver of Irregularities. The District reserves the right to reject any or all Bid Proposals or to waive any irregularities or informalities in any Bid Proposal or in the bidding. Award of Contract. The Contract for the Work, if awarded, will be by action of the District's Board of Trustees to the responsible Bidder submitting the lowest priced responsive Bid Proposal. If Alternate Bid Items are included in the bidding, the lowest priced Bid Proposal will be determined on the basis of the Base Bid Proposal or on the Base Bid Proposal and the combination of Alternate Bid Items selected in accordance with the applicable provisions of the Instructions for Bidders. Payment Bond; Performance Bond. Prior to commencement of the Work, the Contractor shall furnish a Performance Bond as security for Contractors faithful performance of the Contract and a Labor and Material Payment Bond as security for payment of persons or entities performing work, labor or furnishing materials in connection with Contractors performance of the Work under the Contract Documents. Unless otherwise stated in the Special Conditions, the amounts of the Performance Bond and the Payment Bond required hereunder shall be one hundred percent (100%) of the Contract Price. Said Labor and Material Payment Bond and Performance Bond shall be in the form and content set forth in the Contract Documents. The failure or refusal of the Contractor to furnish either the Performance Bond or the Labor and Material Payment Bond in strict conformity with this Article 6.4 may be deemed by the District as a default by the Contractor of a material obligation hereunder. The Surety on any bond required under the Contract Documents shall be: (i) an Admitted Surety Insurer as that term is defined in California Code of Civil Procedure 995.120; and (ii) A.M. Best rated A-/VII or better.
