The work on these projects includes right-of-way green stormwater infrastructure (GSI) and community gathering spaces with adjacent rain gardens and swales on vacant lots and a community center site. Elements within these projects include, but are not limited to, installation of subsurface detention, porous pavement and porous asphalt, tree pits, sidewalk planters, stormwater bumpouts, drainage system improvements including inlets and connected laterals, site furnishings and planting, and Americans with Disabilities Act (ADA) compliant curb ramps. The work is geographically located at Midtown (4th Street between Harris and Reily Streets and Harris Street between Fulton and Logan Streets), Boys & Girls Club (1227 Berryhill Street), Peffer (4th and Peffer Streets), and Swatara (430-418 S 15th Street) as indicated on the drawings. The work includes all materials, equipment, labor, necessary apparatuses, and other miscellaneous labor and materials as contemplated by the Contract Documents. CLARIFICATION DEADLINE 6/14/2022 4:00 PM Notice is hereby given that Capital Region Water has adopted the Minority Women and Disadvantaged Business Enterprise Plan to ensure that minority, women, and other disadvantaged business enterprises have an equal opportunity to receive and participate in all project related construction contracts. Following the submission of DBE documentation in compliance with EPA Regulations regarding initial solicitations, it is the intent of Capital Region Water to ensure nondiscrimination in the award and administration of contracts, to create a level playing field on which minority, women, veteran, service-disabled-veteran, and LGBT-owned business enterprises can compete fairly for Capital Region Water Contracts and subcontracts, to help remove barriers to the participation of minority, women, veteran, service-disabled veteran, and LGBT-owned business enterprises and to assist the development of firms that can compete successfully in the marketplace outside of this program. CRW will establish minimum participation levels (MPLs) for the MBEs, WBE, and other DBEs on a project-by-project basis. Contracts awarded under this invitation are funded through the Pennsylvania Infrastructure Investment Authority (PENNVEST), supported in part by Federal funding. This Project and the Work performed thereon is subject to federal prevailing wage rate laws (Davis Bacon Act). Notice is also given that this project is being federally funded by the EPA financial assistance dollars and therefore requires all contractors to demonstrate compliance with federal Executive Order 11625, 12138, and 12432 and EPA Regulations at 40 CFR Part 30, et al., through the detailed documentation of solicitation of Disadvantage Business Enterprises (DBEs). Contractors must demonstrate the Six Good Faith Efforts to identify and solicit DBE firms that are potential sources for any procurement action in the areas of project construction, equipment services, and supplies by including state qualified small businesses and minority and women owned business enterprises in the bidding process. DBE documentation must be submitted with the Bid. Bidders shall use the CRW form included in the Bidding Documents. A Bid Security in the amount of ten percent (10%) of the Bid shall accompany each Bid in accordance with the Instructions to Bidders. The Bidder to whom a Contract is awarded shall furnish a Performance Bond and a Payment Bond each in an amount equal to the Contract Price. The successful bidder and the Work performed on the Project must comply with the requirements for the purchase of American Iron and Steel in accordance with the provision of the Federal Consolidated Appropriations Act, January 17, 2014, P.L. 113, No. 76, 436 and the Pennsylvania Steel Products Procurement Act, March 3, 1978, P.L. 6, No. 3, 78 P.S. 1881 et seq. The Work shall be substantially complete 365 days after the date when the Contract Time commences. Bidders shall include a construction schedule demonstrating how they plan to sequence the construction of all four projects within the 365 day construction period to reach substantial completion. No Bid shall be withdrawn for a period of 60 days after the opening of Bids without written consent of the Owner. Capital Region Water reserves the right to reject any and all Bids, to waive any defects, errors, and omissions, irregularities, or informalities in a Bid or the Bid procedure, and to accept any Bid deemed to be favorable to its interest.
