The County plans to make improvements to the Dam's water retaining structures in the summer of 2023 and anticipates that the construction activities may require partial or complete drawdown of the reservoir as well as activities in the area immediately downstream of the dam. The County understands that any drawdown of the reservoir or activities in the Flat River downstream of the dam may require a mussel survey to identify and potentially relocate threatened or endangered native mussel species. Award of Assignment: The County will award the assignment to the selected Consultant no later than June 13, 2022. Notice to Proceed: Pending the successful completion of contract negotiations, the County will issue the notice to proceed with the selected Consultant on June 27, 2022. Consultant will perform a site visit to observe the extent of the reservoir and downstream areas where construction activities may take place. The site visit will also familiarize the Consultant with the project boundary, reservoir and downstream access locations, and staging areas. The County will provide assistance during the site visit. Consultant will indicate the extent of the site visit requirements in their proposal, including the assistance required by the County in support of the visit. Consultant will consult appropriate state and federal (if required) agencies to discuss the upper Flat River Group designation and identify the permits which would be required to conduct the mussel survey. he Consultant will work in consultation with the appropriate agencies to obtain mussel survey permits. Deliverable: Consultant will submit a brief letter report weekly documenting the results of consultations with the state and federal (if required) agencies throughout the permitting process. The report should provide an appendix with the meeting dates, locations, participants and minutes. Consultant should also submit to the County mussel survey permit applications when filed, and issuance of permits when obtained. Develop Mussel Relocation Plan and identify Permit Requirements: Consultant will consult appropriate state and federal (if required) agencies to discuss Consultant's mussel relocation plans to assist the County during the improvements to the dam's embankments and spillway, and identify the permits which would be required to conduct the mussel relocation plan. Attached is Kent County's Standard Agreement and General Conditions Between Owner and Bidder that will govern this Project (hereinafter, the "Contract"). Bidders shall review the Contract and indicate acceptance on its bid response. Bidder should disclose any modifications it deems necessary and provide comments on the Agreement. Kent County reserves the right to reject any proposed edit or counteroffer.
