The Borough is soliciting bids from qualified bidders interested in providing solid waste collection services based on service options awarded by the Borough for a five (5) year contract term commencing on April 1, 2023, and ending on March 31, 2028, all in accordance with the terms of the Borough's Bid Specifications and N.J.A.C. 7:26H-6, et seq. All bids must be submitted on the standard bid forms in the manner designated in the Bid Specifications and must be enclosed in a sealed envelope addressed to Borough Clerk and bearing the name and address of the bidder and the name of the contract. The mailing of sealed bids is preferred. However, if a bid is hand delivered, bidders shall drop off sealed bids at the designated drop box located outside Borough Hall. Borough representatives will time-stamp, collect and ascertain that all submittals have been timely delivered prior to the date and time scheduled for bid opening. All bids must be accompanied by a non-collusion affidavit and guarantee pursuant to N.J.S.A. 40A:11-21, in the form of a bid bond, cashier's check or certified check in the amount of ten percent (10%) of the amount bid, not to exceed $20,000; a certificate from a surety company acceptable to the Borough pursuant to N.J.S.A. 40A:11-22; a statement of corporate ownership pursuant to N.J.S.A. 52:25-24.2; a listing of subcontractors pursuant to N.J.S.A. 40A:11-16; and an acknowledgment of the bidder's receipt of any notice of revisions or addenda to the advertisement or bid documents. Performance and payment bonds for the full amount of this project are required. The successful bidder is required to comply with all applicable statutory and regulatory requirements, which include, but are not limited to, the business registration requirements of N.J.S.A. 52:32-44; the public works contractor registration requirements of N.J.S.A. 34:11-56.48 et seq.; the anti-discrimination requirements of N.J.S.A. 10:2-1 et seq., N.J.S.A. 10:5-31 et seq., P.L. 1975, c. 127, and N.J.A.C. 17:27; and the Americans with Disabilities Act of 1990, (42 U.S.C. 12101 et seq.). Bidders are solely responsible for the timely delivery of the bid and no bids shall be considered that are presented after the public call for receiving bids. Any bid received after the date and time specified will be returned, unopened, to the bidder. Bids must be based upon and in strict accordance with the Bid Specifications. Nonresponsive bids will not be accepted. All bids and accompanying documents, as well as bonds and other Contract Documents, are subject to review by the Borough Attorney to ensure compliance with applicable New Jersey laws and regulations. The Borough reserves the right to reject any and all bids and to waive any informalities therein and to accept any bid that will be in the best interest of the Borough according to N.J.S.A. 40A:11-1. No bid may be withdrawn for a period of sixty (60) days after the date set for the opening of the bids.
