The Freetown Highway Department, pursuant to Mass. General Laws Ch. 30, 39M, hereby solicits bids for the following items for Fiscal Year 2023: highway salt, road striping, bituminous concrete, stone seals, 20% rubberized asphalt surface treatment, and cold planing. Materials shall meet MassDOT Highway Division specifications. When applicable, vendors shall be in compliance with prevailing wage laws. All bids over $10,000 shall be accompanied by a bid deposit in the amount of five percent (5%) of the bid in the form of cash, a bid bond, or a certified check made payable to the Town of Freetown. The bid deposit will be forfeited if the bidder fails to execute the contract and satisfactory bond within ten (10) days after the contract may have been awarded to him. All awarded contracts shall be subject to the Special Contract Conditions that accompany this bid package. Also, all work being performed requires 100% Performance Bond. In addition, where the contract amount is more than $25,000, a 50% payment bond shall be required in accordance with G.L. c.149, 29. The Town reserves the right to reject any or all bids, and to waive informalities in the bids, or to accept the bid deemed best for the Town. The Town further reserves the right to award one or more portions of the contract to more than one bidder. In this case, the price bid by the bidder for each item as detailed on the Bid Form shall remain the same. The contract, or portions thereof, as the case may be, will be awarded to the lowest, responsible and eligible bidder
