The Deliverables are further described in Appendix B - Deliverables. The University intends to execute a Master Services Agreement, provided in Appendix E. The procurement is anticipated to involve negotiation. An electronic auction is not anticipated. Conditions for Participation The award of a Final Agreement to a Successful Proponent is conditional on the Successful Proponent providing the following information to the University, in accordance the timeframes specified by the University: Insurance: Commercial general liability insurance: General liability insurance in the amount of not less than five million dollars ($5,000,000.00) for any one occurrence for bodily injury, property damage including loss of use, or death. Such insurance shall, at a minimum, include coverage of broad form property damage, contractual liability, completed operations and product liability, sudden and accidental pollution, and such other types of insurance as would be carried by a prudent person performing such services and as the University, may from time to time, require. Such policy shall include the University as an additional insured, include a cross liability/severability of interests clause, and include a waiver of subrogation rights which the Consultant's insurer may have against the University; Standard automobile liability insurance covering vehicles owned by the Supplier and non-owned vehicles with limits of not less than two million dollars ($2,000,000.00), if applicable to this type of service; WSIB (or Equivalent): A clearance certificate from the Ontario Workplace Safety Insurance Board, or if the Successful Proponent is not subject to the Workplace Safety and Insurance Act (Ontario), evidence of employers' liability coverage equivalent to WSIB coverage in the amount of not less than two million dollars ($2,000,000.00). WHMS: Proof of training for WHIMS for all individuals that are assigned to the resulting Agreement with the University. Mandatory Submission Requirements File #1 Proposal Acknowledgement Form - Pass/Fail Minimum Passing Score The Minimum Passing Score for Step 2: Technical is 70% or 42 out of 60 Points. Applicable Trade Agreements This procurement is subject to the following trade agreement(s): o BPS Procurement Directive; o The Canadian Free Trade Agreement, Chapter Five; o The Ontario-Quebec Trade and Cooperation Agreement, Chapter 9]; o Canada-European Union Comprehensive Economic and Trade Agreement (CETA); Contract Details The term of the Final Agreement is three (3) years plus two optional periods of 1 year each, in the discretion of the University.. Suppliers are encouraged to obtain the procurement documents which contain the most current information. If there is a conflict between the procurement documents and this notice, the procurement documents will take precedence. Site Visit(s) will be completed in accordance with the University's COVID-19 Requirements. This will include practicing physical distancing, the use of PPE (masks), completion of a health-screening questionnaire and following Toronto Public Health guidelines.
