A Job Order Contract (hereinafter called JOC), pursuant to PCC 20919, is a competitively bid, firm fixed priced indefinite quantity contract awarded to the most qualified and prequalified bidder. It includes a collection of detailed repair and remodel tasks and Technical Specifications that have established Unit Prices from the Construction Task Catalog. The Unit Prices are based on local labor, material and equipment prices and are for the direct cost of construction. It is placed with a Contractor for the accomplishment of repair, alteration, modernization, maintenance, rehabilitation, etc., of buildings, structures, or other real property at different locations within the school district. Ordering is accomplished by means of issuance of a Job Order against the Contract. The Contractors, under the JOC contract, furnishes all management, labor, materials and equipment needed to perform the work. The Owner selected The Gordian Group's (Gordian) Job Order Contracting (JOC) Solution (Gordian JOC SolutionTM) for their JOC program. The Gordian JOC Solution includes Gordian's proprietary eGordian JOC Applications and Construction Task Catalog, which shall be used by the Contractor to prepare and submit Job Order Proposals, subcontractor lists, and other requirements specified by the Owner. Bid Security in the amount of twenty five thousand dollars ($25,000), as set forth in Section 00 4313, shall accompany each bid. Surety issuing the bid bond shall meet the requirements set forth in Articles 5.17 of the General Conditions. The bidder is responsible for ensuring that they have complete Bidding Documents including all Addenda provided by the OWNER, prior to the bid due date. The anticipated construction range is $25,000 - $1,000,000. The Minimum Contract Value that the Contractor has the opportunity to perform under the Job Order Contract is twenty five thousand dollars ($25,000). The Contract Value is One Million Dollars ($1,000,000). Contractor is not guaranteed to receive this volume of Job Orders. It is merely an estimate. Owner has no obligation to give the Contractor the opportunity to perform Job Orders in excess of the Minimum Contract Value. Contract Term. Job order contracts may be executed for an initial contract term of no more than 12 months (base period), with the option of extending or renewing the job order contract for two 12-month periods upon mutual consent. The term of the job order contract shall be for the contract term or whenever the maximum value of the contract is achieved, whichever is less. All extensions or renewals shall be priced as provided in the request for bids. The extension or renewal shall be mutually agreed to by the unified school district and the job order contractor. The maximum total dollar amount that may be awarded, upon mutual consent, under a single job order (master) contract shall not exceed five million dollars ($5,000,000) in the first term of the job order contract and, if extended or renewed, ten million dollars ($10,000,000) over the maximum two terms of the job order contract adjusted annually on the anniversary of the Notice to Award to reflect the percentage change in the California Consumer Price Index. The Los Angeles Unified School District may issue job orders to the job order contractor that has been awarded the job order contract. The job order issued to the job order contractor shall not commence for seven (7) days from the time the job order was issued and the job order contractor shall provide a minimum of seven days' notice for the addition of any subcontractor or substitution of any subcontractor as described in Section 20919 of the Public Contract Code (PCC). The job order shall be based on a project scope of work prepared by the unified school district as well as a proposal from the job order contractor who is awarded the job order contract. No single job order may exceed one million dollars ($1,000,000). All Job Orders issued during the term of this Contract shall be valid and in effect notwithstanding that the Detailed Scope of Work may be performed, payments may be made, and the guarantee period may continue, after such period has expired. All terms and conditions of the Contract apply to each Job Order. The Contractor may withdraw from the Contract: (1) on the first anniversary of the Contract; or (2) the first anniversary of the option period. In the event the Contractor elects to withdraw from the Contract, it must provide to the Owner 90 days written notice of its intent to withdraw. Exercising an option to withdraw shall not relieve either party from its obligations with respect to Job Orders issued prior to such withdrawal. LICENSE CLASSIFICATION: C-33 - Painting and Decorating Contractor SBE. Bidder is subject to the Small Business Enterprise (SBE) participation requirements as set forth in Section 00 7339. The District has a 25% SBE Participation Goal and a 5% Veteran Business Enterprise participation goal. *The value for this project is based on a financial range. The value is listed as the highest possible cost from the range provided by a stakeholder or official project document.
