Site work for a civil project in Tecumseh, Nebraska. Completed plans call for site work for a water / sewer project.
The extent of the Work involved consists generally of repair and recoating of two standpipes. Standpipe No. 1 (East Standpipe) is a 10' X 85' steel tank and Standpipe No. 2 (Maple Grove Standpipe) is a 10' X 90' steel tank. All Bids must be filed in said office on or before the time herein set on forms furnished by the Owner and must be enclosed in a separate sealed envelope and plainly identified. Each Bid shall be accompanied by a Bid Bond, certified check, cashier's check, or certified credit union share draft in an amount equal to five per cent (5%) of the total amount of the Bid. If Bid Bond is submitted, it must be on the form provided with the Contract Documents. The certified check, cashier's check, or certified credit union share draft shall be drawn on a bank in Nebraska, a bank chartered under the laws of the United States of America, or said certified share draft shall be drawn on a credit union in Nebraska or chartered under the laws of the United States and payable to the Treasurer of the Owner as security that if awarded a contract, the Bidder will enter into a contract at the prices Bid and furnish the required Performance and Payment Bonds in the amount of one hundred per cent (100%) of the Work and Certificate of Insurance. The certified check, cashier's check, or certified share draft may be cashed, or the Bid Bond forfeited, and the proceeds retained as liquidated damages if the Bidder fails to execute a contract or file acceptable Performance and Payment Bonds or provide an acceptable Certificate of Insurance within fifteen (15) days after the acceptance of said Bid by resolution of the Owner. No Bidder may withdraw a Bid within sixty (60) days after the date set for opening Bid. Payment will be made in monthly estimates and one final payment. Payment for the Work completed during the preceding calendar month will be determined by the Engineer pursuant to the General Conditions. Contractor shall submit application for final payment and accompanying documentation, the amount recommended by the Engineer, will be presented to the Owner for consideration. Upon acceptance by the Owner, the final payment will be issued on the balance due, less any sum Owner is entitled to set off the Engineer's recommendation, including but not limited to liquidated damages, and shall not be paid to the Contractor earlier than thirty-one (31) days after the Governing Body's Final Acceptance of the Work. The Work under the Contract for each Division shall commence on or before the date specified in a written Notice to Proceed and shall be Substantially Complete and ready for operation no later than 150 calendar days following the Notice to Proceed, and ready for Final Acceptance no later than 180 calendar days following the Notice to Proceed. Due to the necessity of these tanks in the operation of the water system the tanks cannot be out of service simultaneously and neither tank can be out of service from June 15th to September 1st . Bidder accepts the provisions of the Agreement as to Liquidated Damages of $ 300.00 per day for Substantial and Final Completion in the event of failure to complete the Work within the Contract Times. The Owner hereby reserves the right to reject any or all Bids, to waive informalities and irregularities and to enter into such contracts as it may deem to be for the best interests of the Owner. Contractors and subcontractors on USEPA federally assisted construction projects are required to pay their laborers and mechanics wages not less than those established by the U.S. Department of Labor. A current wage decision containing the appropriate building and/or heavy type rates is included in the specifications for bidding purposes. The prospective participants must certify by submittal of EPA Form 5700-49, Certification Regarding Debarment, Suspension and Other Responsibility Matters, that to the best of its knowledge and belief that it and its principals are not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from covered transactions by any federal department or agency. Bidders on this work will be required to comply with the President's Executive Order No. 11246. Requirements for bidders and contractors under this order are explained in the specifications. Each bidder must fully comply with the requirements, terms and conditions of the U.S. Environmental Protection Agency, Disadvantaged Business Enterprise (DBE) requirements, including the fair share objectives for disadvantaged business participation during the performance of this contract. The bidder commits itself to the fair share objective for disadvantaged business participation contained herein and all other requirements, terms, and conditions of these bid conditions by submitting a properly signed bid. On January 17, 2014, H.R. 3547, "Consolidated Appropriations Act, 2014," was enacted. Section 436 of the Act requires that none of the appropriated funds may be used for the construction, alteration, maintenance, or repair of a public water system or treatment works unless all of the iron and steel products used in the project are produced in the United States, unless a waiver is provided to the recipient by EPA. Conditions for the waiver are found under the Information for Bidders. The term "iron and steel products" means the following products made primarily of iron or steel: lined of unlined pipes, fittings, manhole covers, and other municipal castings, hydrants, tanks, flanges, pipe clamps and restraints, valves, structural steel, reinforced precast concrete, and construction materials.
