For the following: Ramp Preventative Maintenance at SouthWest Transit's SouthWest Station. All references in this notice to a time of day are references to the legal local time in Eden Prairie, Minnesota. All bids must be received in a sealed envelope with a label on the envelope identifying the specific procurement for which a bid is being submitted. No combined bids on the same form will be allowed. For construction or facility improvements or subcontracts exceeding the Simplified Acquisition Threshold defined in 2 C.F.R. 200.88 (currently $250,000), if the Federal awarding agency or pass-through entity has not determined that SWT's bonding policy and requirements adequately protect the Federal interest, the following minimum requirements apply: (a) A bid guarantee from each bidder equivalent to five percent of the bid price. The bid guarantee must consist of a firm commitment such as a bid bond, certified check, or other negotiable instrument accompanying a bid as assurance that the bidder will, upon acceptance of the bid, execute such contractual documents as may be required within the time specified. (b) A performance bond on the part of the contractor for 100 percent of the contract price. (c) A payment bond on the part of the contractor for 100 percent of the contract price. Bids must be accompanied a certified check made payable to SouthWest Transit or a corporate surety bond made in favor of SouthWest Transit in an amount of Five Percent (5.0%) of the Base Bid amount. The successful bidder must be a "responsible contractor." The term "responsible contractor" means a contractor as defined in Minnesota Statutes, section 16C.285, subdivision 3. Any prime contractor, subcontractor, or motor carrier that does not meet the minimum criteria or fails to comply with the verification requirements is not a responsible contractor and is not eligible to be awarded a construction contract for the project or to perform work on the project. A prime contractor, subcontractor, or motor carrier that makes a false statement under oath verifying compliance with the minimum criteria will be ineligible to be awarded a construction contract on the project, and the submission of a false statement may result in termination of a contract awarded to a prime contractor, subcontractor, or motor carrier that submits the false statement. A prime contractor shall include in its verification of compliance a list of all of its first-tier subcontractors that it intends to retain for work on the project. Before execution of a construction contract, a prime contractor shall submit a supplemental verification under oath confirming that all subcontractors and motor carriers that the prime contractor intends to use to perform project work have verified to the prime contractor, through a signed statement under oath by an owner or officer, that they meet the minimum criteria for a responsible contractor. SouthWest Transit reserves the right to reject any and all bids, to waive minor irregularities and informalities therein, to delay the award for any reason, to remove or delete work or units of work without penalty from the contractor, and to award each contract in the best interest of SouthWest Transit.
