If the total amount of the bid exceeds $100,000.00, the bid shall be accompanied by a certified check or bank draft, payable to the HOC, or a satisfactory Bid Bond executed by the bidder and a Surety that is acceptable to the Federal Government, in an amount equal to Five Percent (5%) of the bid. Failure to comply with this requirement may cause the bid to be considered non-responsive, and subject to rejection. If the total amount of the Contract exceeds $100,000.00, the successful bidder will be required to furnish and pay for satisfactory Performance and Payment Bonds for 100% of the Contract Value. The Time to complete this work shall be Ninety (90) consecutive calendar days from the date of the Notice to Proceed. If the Contractor fails to complete all of the work as specified within Ninety (90) consecutive calendar days, HOC reserves the right to terminate the contract and/or to pursue Liquidated Damages in the amount of $300.00 per unit for each day.
