In addition, the Contractor shall be responsible for compliance with requirements of Section 1777.5 of the California Labor Code relating to apprentices of public works contracts. No contractor or subcontractor may be listed on a bid proposal or awarded a contract for public work on a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code Section 1725.5 [with limited exception from this requirement for bid purposes only under Labor Code section 1771.1(a)]. This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations pursuant to Labor Code Section 1771.4. Bids must be prepared on the approved Proposal forms in conformance with A2-INFORMATION FOR BIDDERS and submitted in envelopes, sealed and plainly marked on the outside, "SEALED BID FOR FY2021-22 ANNUAL ROAD MAINTENANCE PROJECT, DO NOT OPEN WITH REGULAR MAIL". The bid must be accompanied by a bid guarantee in the form of a certified or cashier's check or bidder's bond, made payable to the CITY OF BUELLTON for an amount no less than ten percent (10%) of the total bid amount. The CITY will deduct a five percent (5%) retention from all progress payments as specified in C7- MEASUREMENT & PAYMENT. The contract will not be awarded to a Contractor who does not hold a valid Class "A", or "C-32" license in accordance with the provisions of the Business and Professions Code. The CITY reserves the right to reject any or all bids, to waive any irregularity, and to take all bids under advisement for a period of forty-five (45) days.
