Similarly, the envelope must be clearly identified as described above. If the City allows tenders to be submitted electronically, this choice will be specified on the website of the Electronic Tendering System and according to the terms determined and in the notice published by the City. In such a case, tenders may be transmitted electronically through the Electronic Tendering System only. For any tender transmitted in paper format, the tenderer must provide inside its sealed envelope ONE (1) USB key, containing an unlocked electronic copy of the original papers placed in this envelope. The USB key must be clearly identified, as the case may be, by the words COPY N (number) and the project number. Bids will be publicly opened in the City Council Chambers at the above address, immediately after the set deadline. The Cities and Towns Act provides that tender documents and any additional document related thereto can only be obtained through the Electronic Tendering System (SEAO). Persons interested in this contract must obtain the tender documents by contacting the SEAO by contacting representatives by telephone at 1 866-669-7326 or 514-856-6600, or by consulting the website: www. seao.ca. _ The cost of the documents is established by the SEAO. To be eligible, all bidders must meet the eligibility conditions listed in the tender documents. In addition, bidders must refer to the tender documents in order to comply with the compliance conditions set out therein. Bids must be submitted on the forms prepared for this purpose and submitted in triplicate paper copies (one original identified as such and two copies) in sealed envelopes, identified with the call for tenders number OR transmitted electronically (if accepted by the City) according to the terms and conditions in effect. Any submission that does not include the following documents will be deemed non-compliant and automatically rejected: A tender deposit equal to ten percent (10%) of the total amount of the tender, in the form of a certified check, money order or bank draft issued by a financial institution and payable to the order of the Town of Kirkland; Where An irrevocable letter of guarantee issued by a financial institution or A bid bond corresponding to ten percent (10%) of the total amount of the bid issued by an insurance company having its place of business in Quebec, valid for four- ninety (90) days from the date of opening of tenders. AND A letter of intent or undertaking from a Canadian chartered bank to provide an irrevocable letter of bank guarantee or from an insurance company to provide a performance bond in the value of fifty percent ( 50% ) of the total amount of the bid in favor of the Town of Kirkland, valid for the entire duration of the contract. Or In the case of a bid sent electronically , as bid security, only the surety bond and the irrevocable letter of guarantee are accepted during the transmission of the bid. No other form of guarantee is accepted with this mode of transmission. If the tender documents provide for another form of bid guarantee (certified or certified cheque, money order or bank draft), and the bidder wishes to take advantage of it, the bid must be submitted exclusively on paper. The City does not undertake to accept either the lowest bid or any of the bids received, without incurring any obligation or expense of any kind towards the bidder(s). In addition, the City reserves the right to disregard any defect deemed minor in a bid if this does not break the rule of equality between bidders.
