Site work for a water / sewer project in Charlottesville, Virginia. Completed plans call for site work for a water / sewer project.

As of July 26, 2022, this project was awarded to KBS EARTHWORKS, INC. for $762,277.27. This project consists of construction of a Priority II and III stream restoration to stabilize 818 linear feet of tributaries to Schenks Branch (769 linear feet of Schenks Branch Tributary and 49 linear feet of an unnamed tributary at its confluence with Schenks Branch Tributary). The project is located in McIntire Park, in the future location of the Botanical Garden of the Piedmont. The restoration project limits are defined by the upstream Norfolk Southern Railroad right-of-way downstream to the John Warner Parkway overpass. Schenks Branch Tributary is experiencing active severe erosion of its banks and bed, sending excessive amounts of sediment downstream to waterways listed as impaired by the Virginia Department of Environmental Quality (DEQ). As a result, the stream offers poor habitat for aquatic organisms and is largely inaccessible to the public. Schenks Branch Tributary's current condition has been assessed, and design of a restoration approach that will bring the stream back to a stable and healthy state was completed. The Schenks Branch Tributary design utilizes an approach that aims to emulate natural, stable river systems. The design for Schenks Branch Tributary includes grading of the stream bed and banks and installation of features such as riffles, pools, cross vanes, j-hook vanes, toe wood, soil lifts, and a rock cascade. The project includes a planting plan that will meet ecological and stream requirements while fitting into the overall fabric of the Botanical Garden site. The planting plan includes native seed mixes, plugs, live stakes, shrubs, and trees. The goals of this stream restoration are to reduce pollution, increase ecological function, and improve overall condition of the stream, all while integrating with the planned Botanical Garden of the Piedmont. The restored stream will become an important component of the Botanical Garden of the Piedmont and provide a unique opportunity for the community to interact with and see the benefits of stream restoration. The project is being funded by grant funds from the DEQ's Stormwater Local Assistance Fund (SLAF) and matching funds from the City of Charlottesville, VA (City). The Contractor is to provide all supervision, equipment, labor and materials necessary to complete the work as described above. Work to Commence: Four (4) weeks from date of ratified contract Substantial Completion: Six (6) months from the date of ratified contract Final Completion: Seven (7) months from the date of ratified contract Due to the length, complexity and technical nature of this solicitation, it is not being posted on the City website in an accessible format; however, accommodations will be made upon request by submitting an email request to purchasing@charlottesville.gov. Each bid in excess of $100,000 submitted in response to this IFB shall be accompanied by a bid bond in an amount equal to five percent (5%) of the total monetary amount of the bid (total base bid plus all additive bid items). The bid guarantee may be either (i) a certified or cashier's check made payable to "The City of Charlottesville, Virginia," or (ii) a bid bond made payable to "The City of Charlottesville, Virginia." The bid guarantee shall be for the purpose of promising and guaranteeing that the bidder will not withdraw its bid for a period of 30 days following bid opening. The proceeds of the bid guarantee shall be and remain the sole property of the City, as liquidated damages, should the successful bidder fail to execute a contract, proof of all required insurance and endorsements and all required payment and performance bonds within five days of the City's issuance of notice of award of the contract. In lieu of a bid bond, a bidder may furnish a certified check or cash escrow in the face amount required for the bond, or, if approved in advance by the city attorney, a bidder may furnish a personal bond, property bond, or a bank or savings institution's letter of credit on certain designated funds in the face amount required for the bid bond. The parties hereto mutually understand and agree that the City will sustain substantial monetary and other damages in the event of a failure or delay by the General Contractor in the completion of its scope of the Work. If the General Contractor inexcusably fails to achieve Substantial Completion by the date established by this Contract, then the General Contractor shall pay to the City, as liquidated damages for delay and not as a penalty, the daily amount specified in this Contract for Construction, for each and every day after the required date of Substantial Completion until actual Substantial Completion. This liquidated damages provision shall apply and remain in full force and effect in the event that General Contractor is terminated by City for default and shall apply until Substantial Completion has been achieved by any other contractor(s) hired to complete the Work. If the General Contractor inexcusably fails to achieve Final Completion by the required date of Final Completion established in this Contract, the General Contractor shall pay to the City, as liquidated damages for delay and not as a penalty, the daily amount specified in this Contract for Construction, for each and every day after the required date of Final Completion until actual Final Completion. The General Contractor shall not be entitled to, and hereby waives any monetary claims and damages, of any nature whatsoever, arising from or related to any of the following: lost income, lost profits, lost financing, loss of reputation, lost business opportunities, loss of management or employee productivity or of the services of such persons; unabsorbed overhead, and principal office expenses (including, without limitation, the compensation of personnel stationed there, for losses of financing, business and reputation and for loss of profit). Nothing contained in this paragraph shall be deemed to preclude an award of liquidated damages, when applicable, in accordance with the requirements of the Contract Documents. The Owner shall have the right to reject any proposed replacement. Under no circumstances shall the Owner be required to consent to a proposed replacement under circumstances where such replacement would result in an increase in the Contract Price.
