The Acquisitions and Contract Administration Section of the Purchasing Division ("Purchasing Division") is soliciting Expression(s) of Interest ("EOI" or "Bids") for the West Virginia Department of Environmental Protection, Division of Land Restoration, Office of Abandoned Mine Lands and Reclamation (WVDEP-DLR-AML) ("Agency"), from qualified firms to provide architectural/engineering services ("Vendors") as defined herein. he mission or purpose of the Group of Projects (as listed below 1 through 7) for which bids are being solicited is to provide the subsequent planning, realty, design, and construction services for each; including but not limited to (as may be applicable to each project): 1) Crumpler (Scott) Draining Portal project 2) Gilliam Refuse Pile project 3) Greenbrier Hollow Refuse - Phase II project 4) Algoma Refuse project 5) Crany Mine Dump - Phase II project 6) Drews Creek Dangerous Impoundment project 7) Indian Creek (Dillon) Portals project o National Environmental Policy Act (NEPA) consultations and documentation o Public Participation o Infrastructure Investment Jobs Act (IIJA) compliance o Determine legal ownership of properties Question Submission Deadline: 06/23/2022 @ 4:00 PM ET Submit Questions to: Josh Hager 2019 Washington Street, East Charleston, WV 25305 Fax: (304) 558-3970 Email: Joseph.E.HagerIII@wv.gov Pursuant to the requirements contained in W. Va. Code 5-22-1(c), All Vendors submitting a bid on a construction project shall furnish a valid bid bond in the amount of five percent (5%) of the total amount of the bid protecting the State of West Virginia. The bid bond must be submitted with the bid. The apparent successful Vendor shall provide a performance bond in the amount of 100% of the contract. The performance bond must be received by the Purchasing Division prior to Contract award The apparent successful Vendor shall provide a labor/material payment bond in the amount of 100% of the Contract value. The labor/material payment bond must be delivered to the Purchasing Division prior to Contract award. In lieu of the Bid Bond, Performance Bond, and Labor/Material Payment Bond, the Vendor may provide certified checks, cashier's checks, or irrevocable letters of credit. Any certified check, cashier's check, or irrevocable letter of credit provided in lieu of a bond must be of the same amount and delivered on the same schedule as the bond it replaces. A letter of credit submitted in lieu of a performance and labor/material payment bond will only be allowed for projects under $100,000. Personal or business checks are not acceptable. Notwithstanding the foregoing, West Virginia Code 5-22-1 (d) mandates that a vendor provide a performance and labor/material payment bond for construction projects. Accordingly, substitutions for the performance and labor/material payment bonds for construction projects is not permitted. The apparent successful Vendor shall provide a two (2) year maintenance bond covering the roofing system. The maintenance bond must be issued and delivered to the Purchasing Division prior to Contract award The State may accept or reject any bid in whole, or in part in accordance with W. Va. Code of State Rules 148-1-4.5. and 148-1-6.4.b. The Method of Contractor Selection has not been determined at this Time.
