The City of Sonora (City), by way of this Request for Proposals (RFP), is seeking submittals of qualifications and fees for the purpose of selecting a consultant for construction management engineering services for the Washington-Stockton Corridor -- Downtown Transit & Accessibility Improvement Project (Project). The Consultant is to provide services in a manner satisfactory to the City and consistent with any standards required as a condition of this Project. The Project is located along Stockton Street (Highway 49) from S. Washington Street to east of Green Street. As shown on the approved plans, it will provide new transit and pedestrian facilities within the project area. Improvements will include bus stops, sidewalk/curb and gutter infill or replacement, driveway conforms, drainage improvements, street lighting, signal modifications, ADA compliant curb ramps, and traffic striping/markings/signage where needed. All improvements are anticipated to be within the City or State right-of-way. Stockton Street is also State Highway 49 and is on both the State Highway System and National Highway System. This project is a "public works" project under Section 1720 of California Labor Code and the provisions of Section 1720 through 1861 of the California Labor Code shall apply. This project is subject to compliance monitoring and enforcement by the California Department of Industrial Relations (DIR) and Minimum Federal Wage Rates. This services provided under this RFP are funded with local, state and federal funds. The selected Consultant must be familiar with all pertinent local, state, and Federal laws, regulations, requirements, standards, policies, procedures, and manuals. This includes compliance with State Highway Administration and Federal Highway Administration requirements. The City reserves the right to investigate the qualifications of all firms and persons under consideration including reference checks to confirm any part of the information furnished by a Respondent. As the services being provided under this RFP are federally funded, it is subject to Disadvantage Business Enterprise (DBE) requirements. Consultant's attention is directed to the documents included under Exhibit D of this RFP. The DBE goal for this project is 16%. Selected Consultant must provide written documentation of DBE's participation to confirm that the DBE is participating in the contract. Section Il -- Proposal Submittal Requirements The proposals submitted in response to this RFP will be used as a basis for selecting the Consultant for this project. The Consultant's proposal will be evaluated and ranked according to the criteria provided in this RFP. Unsigned proposals or proposals signed by an individual not authorized to bind the prospective Consultant will be considered nonresponsive and rejected. All proposals will remain firm for one hundred twenty (120) days following the closing date of the receipt of proposals. All documents, including specific RFP responses, submitted to the City become the property of the City. All materials submitted by proposals are subject to public inspection under the California Public Records Act, except that the City may withhold from disclosure clearly marked confidential trade secret information contained in any proposals, and proposals submission of information so marked shall constitute its agreement to defend and indemnify the City from any claim or liability for non-disclosure thereof. After award of the contract, all responses will be regarded as public records and will be subjected to review by the public. Any language purporting to render all or portions of the proposal confidential will be regarded as non- effective and be disregarded. This RFP is not an agreement to purchase or contract for services. The City reserves the right to modify or cancel in whole or in part this RFP, to reject any and all proposals, to accept the proposals they consider most favorable to the City's interests in their sole discretion, and to wave irregularities or informalities in any proposals or in the proposal procedures. The City reserves the right, in its sole discretion, not to enter into a contract as a result of this RFP. The City further reserves the right to reject all proposals and seek new proposals when the City considers such procedure to be in their best interests. All responses will be assessed in light of the needs described in this RFP. The City reserves the right to modify the terms of this RFP at any time, and may cancel this RFP or further review of responses at any time without entering into a contract.
