Only firms having an establishment in Quebec or, when an intergovernmental agreement is applicable, in a province covered by this agreement are authorized to bid. It is agreed that all the information given or communicated by an employee of the engineer's office cannot be used to interpret the plans and specifications, nor be supplementary to them, since they are given for information only and do not in any way commit responsibility of the engineer or his office. Each tender must be accompanied by a certified check drawn on an account registered in a banking institution or a credit union doing business in Quebec set at ten percent (10%) of the amount of the tender presented, or bid bond or an irrevocable letter of guarantee issued in favor of the Municipality in the amount equivalent to ten percent (10%) of the total value of the bid and valid for a period of one hundred and twenty days (120) following the opening of tenders. Only a bid bond established by an insurer holding an insurer's license issued by the Autorité des marchés financiers, and the authorization to practice guarantee activity within the meaning of the Insurance Act and in accordance with standardized form NQ 1809 -900/A will be accepted under the terms of the tender documents.
