Bidders offering alternative solutions (equals) than the ones listed in Line Items, require authorization from the Authority prior to submitting a bid. Equals shall be requested by submitting a question using this solicitation portal during Q&A. The Authority will either approve or reject the request prior to bids due date. The Authority reserves the right to reject unauthorized equals and deem bids non-responsive. Requested equal shall comply with the Authority advertised requirements and if, for each item requested, is not a direct replacement to one requested by the Authority, it shall meet similar specifications. Bidder shall demonstrate compliance of this requirement in a comparison specifications table (Authority specified against requested equal) for each requested item. 3. Requested equal shall comply with Federal Railroad Administration (FRA), Federal Transit Administration (FTA), and Code of Federal Regulations (CFR) requirements. 4. Request shall include verifiable results of usage over time and field-testing results, for each item requested. 5. Request shall include life expectancy, lifecycle costs, service requirements, and lifetime parts availability for each item requested. 6. Request shall include any applicable certifications for each item requested. 7. Request shall include any applicable technical and safety data sheets for each item requested. 8. The Authority reserves the right to test the requested equal, in a lab environment and/or in the field, before or after award, and reject it with no obligation to receive the ordered parts in case of non-compliance, or unsatisfactory results. Bidder shall reimburse the Authority for all costs incurred including, but not limited to, the total cost of purchasing the parts including taxes, fees, and freight, internal testing costs, and any service interruptions due to inappropriate parts supplied by Bidder. 9. Attachments, including drawings or schematics, may be submitted as PDF files. 10. A separate Q&A entry shall be used for each request submitted. 11. Questions submitted with inadequate data, information, etc., will be denied.
