The award will be made to the lowest responsive, responsible Bidder in accordance with these Contract Documents, but the District reserves the right to reject any and all Bids and waive minor discrepancies in the Bid. Copies of the Contract Documents are on file and may be examined at the office of the Engineers. The successful Bidder shall produce the required Performance and Payment Bonds within fifteen (15) calendar days from the award of the Contract. said bonds to be obtained from a surety company satisfactory to the District and insurance coverage in defined coverages and amounts. Attention of Bidders is particularly called to the requirements as to conditions of employment to be observed and minimum prevailing wage rates to be paid under the Contract, said items being contained in the Specifications. In accordance with the provisions of California Labor Code 1770, 1773, 1773.1, 1773.2, 1773.6 and 1773.7, the general prevailing rate of wages and employer payments for health and welfare, pension, vacation, travel time and subsistence pay as provided for in 1773.8, apprenticeship or other training programs authorized by 3093, and similar purposes applicable to the work to be done in the County of Tulare has been determined by the DIR Director. An unregistered Contractor may submit a Bid (as long as the Bid is authorized by 7029.1 of the Business and Professions Code or by 10164 or 210103.5 of the Public Contract Code), provided the Contractor is registered to perform public work pursuant to 1725.5 of the Labor Code at the time the Contract is awarded. Prior to award of the Bid, the Contractor or Subcontractor shall provide proof of said current registration with the DIR to perform public work to the Tipton Community Services District. This Work is subject to compliance monitoring and enforcement by the DIR. Contractors and Subcontractors must submit electronic certified payroll records, as provided under Labor Code 1776, to the Labor Commissioner. These records must be submitted on a weekly basis or as required by statute or by the DIR. A time limit for the final completion of the Work of Seventy (70) calendar days, from the issuance of the Notice to Proceed, has been set and liquidated damages shall be assessed according to the Contract Documents for each calendar day thereafter that the Work is not completed. Issuance of the Notice to Proceed will be based on the date provided in the Bid Proposal, not to exceed three (3) months from the date of the Notice of Award. No pre-Bid conference is currently scheduled. Prospective Bidders shall be licensed Contractors in the State of California and shall be skilled and regularly engaged in the general class or type of work called for under the Contract. In accordance with the provisions of California Public Contract Code 3300, the District has determined that the Contractor shall possess a valid C-57 (Water Well Drilling) Contractor's license. Failure to possess said license at the time of award shall render the Bid non-responsive and shall act as a bar to award of the Contract to any Bidder not possessing said license.
