Install 4812 linear feet of 6-inch PVC water line and 167 linear feet of 8-inch HDPE waterline on north side of 32nd Avenue and abandon existing ACP water line. Any bid received by the City Clerk more than ninety-six (96) hours, excluding Saturdays, Sundaysand holidays, before the time set for the opening of bids, or any bid so received after the time setfor opening of bids, shall not be considered and shall be returned unopened to the biddersubmitting same. Bids will be referred to city staff for evaluation. The City Council may award to the "lowest andbest responsible bidder". The Council reserves the right to reject any or all bids or portions thereofand to waive any technicalities in the bidding process. No bid may be altered, withdrawn, orresubmitted within 45 days after the date set for the opening of bids. Each bidder is required to submit with their bid a guarantee in the form of an acceptable bidder'sbond, a certified check, or a cashier's check on a solvent bank in the state of Oklahoma, and in Notice to Biddersiithe amount of not less than five percent (5%) of the amount bid. The successful bidder shallexecute a contract within 14 days of notice of award by the city. The successful bidder shall file a performance bond, maintenance bond, statutory bond andcertificates of insurance in the statutory amounts for public liability and workers compensationinsurance at the time of signing the contract Any agreement entered into as a result of this invitation to bid shall be construed under thelaws of the State of Oklahoma, and the venue for enforcement of the agreement shall be theState of Oklahoma. City may issue addenda as may be necessary in the best interest of the public and the City of Stillwater. Addenda may amend the date and/or time for receipt of bids or anyspecification, item, document, or requirement in the Bidding Documents upon notice to allprospective bidders who signed the sign-in sheet at the Pre-Bid Conference
