Renovation of a mixed-use development in Camden, New Jersey. Completed plans call for the renovation of a 9,940-square-foot, four-story above grade municipal facility.
The Project consists of renovations of the interior of the CCMUA's three story Service and four story Administration Buildings located in Camden, New Jersey. In the event of any inconsistencies between this advertisement, as published, and the bid documentation, the bid documentation shall control Bids will be received for a single prime Contract. Bids shall be on a lump sum and unit price basis, as indicated in the Bid Form. Bidders are required to comply with the requirements of P.L. 1975, c.127 (N.J.A.C. 17:27 and N.J.S.A. 10:5-31 et seq.), Affirmative Action. Bidders are required to comply with the requirements of P.L. 1999, c. 238 (N.J.S.A. 34:11-56.25 et seq,), New Jersey State Prevailing Wage Act, where applicable. Prospective Bidders are advised that the Project is subject to a Project Labor Agreement (PLA). The PLA will be binding upon all Contractors and Sub-contractors performing on-site Project work, as defined in Article 3 of the PLA Agreement. The copy of the PLA agreement is attached to the Supplementary Conditions, Exhibit 10. Proposals are being solicited through a fair and open process in accordance with N.J.S.A 19:44A-2.02, et seq., and as such, contractors are exempt from the limitations on making political contributions under that law. Further, for that reason, as well as because of a language in the New Jersey's Annual Appropriations Act, refusal to disclose campaign contributions otherwise required by NJSA 19:44A-20.2 et seq. and 19:44A-20.25 et seq., will not adversely affect your consideration for award. This contract or subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the State of New Jersey, the New Jersey Environmental Infrastructure Trust nor any of their departments, agencies or employees is, or will be, a party to this contract or subcontract or any lower tier contract or subcontract. This contract or subcontract is subject to the provisions of N.J.A.C. 7:22-3, 4, 5, 9 and 10. In accordance with the provisions of N.J.S.A. 58:11B-26, N.J.A.C. 7:22-3.17(a)24 and 4.17(a)24, the contractor (subcontractor) shall comply with all of the provisions of N.J.A.C. 7:22-9 for the participation of small business enterprises owned and controlled by Socially and Economically Disadvantaged (SED) individuals. Bidders are advised the SED goal for this project is twelve percent (12%). Bidders also shall be required to comply with the provisions of the following additional State Laws and Regulations: 1. Local Public Contracts Law N.J.S.A. 40A:11-2 et. seq. as supplemented and amended 2. P.L. 2017, c. 317, which establishing standardized changed conditions clauses for certain local public contracts and supplementing P.L. 1971, c. 198 (N.J.S.A. 40A: 11-1 et seq.). 3. Disclosure Notice (P.L. 1977, c33) N.J.S.A. 52:24.1). 4. Title VI of the Civil Rights Act of 1964, Employment on Public Works (N.J.S.A. 10:2-1). 5. New Jersey Law against Discrimination (N.J.S.A. 10:5-1 to 10:5-42). 6. Statement of Corporate Ownership (Stockholder Disclosure Certification) as required under N.J.S.A. 52:25-24.2 7. New Jersey Business Registration of Public Contractors (BRC) as required under N.J.S.A. 52:32-44 8. New Jersey Public Works Contractor Registration Act (N.J.S.A. 34:11-56.48 et. seq) 9. Foreign Corporation Law (N.J.S.A. 14A:13.3) 10. Use of Domestic Materials (N.J.S.A. 52:33-1 to 52:33-3) 11. Prompt Payment Law (N.J.S.A. 2A:30A-2 et seq.) 12. Procedures and Requirements of the Loan (N.J.A.C. 7:22-3.1, 4.1, and 5.1) 13. Environmental Assessment Requirements (N.J.A.C. 7:22-10.11) 14. Construction of Environmental Infrastructure Facilities (N.J.A.C. 7:14.2) 15. Federal P.L. 113-76 American Iron and Steel. In order to perform public work, the Successful Bidder and Subcontractors prior to contract award shall hold or obtain such licenses as required by State Statutes, and Federal and local Laws and Regulations. The Commissioners of the CCMUA require the successful Bidder to prove the necessity of any change order(s). Therefore, please pre-examine everything before submitting your bid. Where the nature or amount of change orders cause suspicion that they are being submitted to purposely inflate your bid, the CCMUA will decline payment and refer the activity to the appropriate law enforcement authorities. The Commissioners will take the same approach to any other subsequent request for increases to the contract price. The Owner reserves the right to reject all of the Bids received, to re-advertise for Bids, to abandon the project, to waive any or all minor informalities in any Bid received and to accept any proposal all in accordance with applicable law." Bid security shall be furnished in accordance with the Instructions to Bidders.
