Site work for a mixed-use development in Durham, North Carolina. Completed plans call for site work for a educational facility.

The required Bid Documents may also be mailed, or hand delivered to the address listed below before August 8, 2022, by 4:00pm. A Prebid conference will not be held. Statement of Qualifications: Each proposal shall be accompanied by a statement of qualifications that demonstrates experience in at least five (5) projects of similar scope within the past three (3) years with references. All Bidders are strongly encouraged to include opportunities for Minority Business participation wherever possible in their respective Bid submission. Minority Business participation is a part of this contract and must comply with all requirements set forth in the Bid Manual. For questions regarding this bid, please email dps@catesvc.com. Durham Public Schools reserves the right to reject any and all bids and to waive informalities or irregularities. Contractors shall include all attachments with this bid that require the contractor to provide information and include an authorized signature where requested. Contractor bid responses shall include the following items and those attachments should be arranged in the following order: a) Cover Letter b) Title Page: Include the company name, address, phone number and authorized representative. c) Completed and signed version of EXECUTION PAGES. d) Completed and accurate MWBE/HUB Affidavits with supporting documentation showing good faith efforts, which may include copies of email and other outreach to MWBE/HUB contractors, unless you are selfperforming the work. e) Bid Form. Contractor and its personnel are required to provide or undergo background checks at Contractor's expense prior to beginning work with the State. As part of Contractor background the details below must be provided to Durham Public Schools: a) Any criminal felony conviction, or conviction of any crime involving moral turpitude, including, but not limited to fraud, misappropriation or deception, of Contractor, its officers or directors, or any of its employees or other personnel to provide services on this project, of which Contractor has knowledge or a statement that it is aware of none; b) Any criminal investigation for any offense involving moral turpitude, including, but not limited to fraud, misappropriation, falsification or deception pending against Contractor of which it has knowledge or a statement it is aware of none; c) Any regulatory sanctions levied against Contractor or any of its officers, directors or its professional employees expected to provide services on this project by any state or federal regulatory agencies within the past three years or a statement that there are none. As used herein, the term "regulatory sanctions" includes the revocation or suspension of any license or certification, the levying of any monetary penalties or fines, and the issuance of any written warnings; d) Any regulatory investigations pending against Contractor or any of its officers, directors or its professional employees expected to provide services on this project by any state or federal regulatory agencies of which Contractor has knowledge or a statement that there are none. e) Any civil litigation, arbitration, proceeding, or judgments pending against Contractor during the three (3) years preceding submission of its proposal herein or a statement that there are none. Contractor's responses to these requests shall be considered to be continuing representations and Contractor's failure to notify Durham Public Schools within thirty (30) days of any criminal litigation, investigation or proceeding involving Contractor or its then current officers, directors or persons providing services under this contract during its term shall constitute a material breach of contract. The provisions of this paragraph shall also apply to any subcontractor utilized by Contractor to perform services under this contract. Any personnel or agent of the Contractor performing services under any contract arising from this bid request may be required to undergo a background check at the expense of the Contractor, if so requested by Durham Public Schools. In the event acceptance criteria for any work or deliverables is not described in contract documents or work orders hereunder, Durham Public Schools shall have the obligation to notify Contractor, in writing ten (10) calendar days following completion of such work or deliverable described in the Contract that it is not acceptable. The notice shall specify in reasonable detail the reason(s) it is unacceptable. Acceptance by Durham Public Schools shall not be unreasonably withheld; but may be conditioned or delayed as required for reasonable review, evaluation, installation, or testing, as applicable of the work or deliverable. Final acceptance is expressly conditioned upon completion of all applicable assessment procedures. Should the work or deliverables fail to meet any requirements, acceptance criteria or otherwise fail to conform to the contract, Durham Public Schools may exercise any and all rights hereunder, including, for deliverables, such rights provided by the Uniform Commercial Code as adopted in North Carolina. Contract changes, if any, over the life of the contract shall be implemented by contract amendments agreed to in writing by Durham Public Schools and Contractor. The successful Bidder is required to execute an agreement between Durham Public Schools and associated Exhibits as included as part of the Bid Manual. After Durham Public Schools has received approval from the Owner, the Bidder shall be notified that they have been successful. At that time, the Bidder shall obtain a payment and performance bond as referenced in the Contract Documents, if required, on the form provided, the appropriate insurance certificates and execute the contract. Failure to execute the Contract and submit acceptable bonds, if required; and insurance certificate within Seven (7) calendar days after Notice of Award may be considered default under the obligation of the bid security. Failure or refusal to furnish bonds, if required, and insurance policies or certificates, schedules of values or other documents in a form satisfactory to the Construction Manager will not be considered an allowable cause for delay. Formal questions are due by July 26, 2022 @ 2:00p.m. RFI questions regarding this bid should be in writing and emailed to dps@cateservices.com. Questions submitted after the noted RFI deadline will not be answered Durham Public Schools is requesting bids, including labor and material, to install new GCFI breakers and GCFI outlets for the outlets servicing the existing water fountains. Scope (1) to include the install of 64 GCFI breakers at the following schools: Hillandale (7) Little River (7) South West (4) Lucas (12) City of Medicine (4) Easley (3) Eastway (6) Sandy Ridge (9) Spring Valley (5) Creekside (7) Work includes but is not limited to the following: Install of new GCFI breaker. Wall finishing to be completed by others.
