The City of Brockton, Department of Public Works, will receive sealed bids for Street Reconstruction at various locations within the City of Brockton, for FY 2023. Said Contract shall be executed on or after July 1, 2022 and continue until June 30, 2023. The City of Brockton reserves the option to extend the terms and conditions of the Contract for FY 2023 to include FY 2024 and FY 2025. Said first extension will commence on July 1, 2023 and continue to June 30, 2024. Said second extension will commence on July 1, 2024 and continue to June 30, 2025. This bid requires MassDOT prequalification. MassDOT prequalification of contractors with the class of work as, (Highway - Construction), for the project with an estimated value of ($6,165,893 a year) will be required.Total project value: $6,165,893 x 3yrs = $18,497,679. The bid must include a photo copy of a certified check or bond drafts, negotiable U.S. Government bonds (at par value) made payable to the City of Brockton, or a satisfactory Bid Bond, executed by the Bidder and an acceptable surety in an amount equal to five percent (5%) of the total bid for Street Reconstruction Contract DPW-BID23-202 shall be uploaded with each bid. The work to be performed under this Contract may be partially funded under City and State funding and a program providing direct Federal financial assistance from the Department of Housing and Urban Development under the Community Development Block Grant Program (CDBG) and is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended 12. U.S.C. 1701 U. Section 3 requires that, to the greatest extent feasible, opportunities for training and employment be given to lower income residents of the project area and contracts for work in connection with the project be awarded to business concerns that are located in or owned in substantial part by persons residing in the area of the project. Work to be performed under this Contract shall comply with Title 5 equal opportunity in employment and equal opportunity in municipal construction projects. The Contractor will be subject to the greater prevailing wage rates of the Davis-Bacon Act, or Minimum State Wage Rates. SCOPE OF CONTRACT The scope and intent of this Contract is to provide all labor, materials, and equipment to perform the reconstruction of existing streets and roadways within the City of Brockton utilizing Massachusetts Chapter 90 funding and U.S. Department of Housing and Urban Development funding under the Community Development Block Grant Program. It is the intent of this Contract to reconstruct various streets at different locations within the City either individually or in groupings when possible, however, the Contractor will be required to commence construction in accordance with the Notice to Proceed regardless of the scope of work. The scope of work may also include, as required by the City, subsurface investigations of various streets in the form of borings and/or test pits not necessarily associated with the reconstruction of that street. The scope of work may also include installation of new traffic control signal equipment or replacement of existing signals with new equipment at various locations in the City. All signal installations shall be paid at the various Contract Unit Prices complete in place as required by the Engineer. Specifications for the signal installations are included in the Special Provisions and are applicable to all signal installations under this Contract. It should be noted that the City will not be providing construction plans, but will establish a written scope of work for each street/location and will provide full time resident inspection to assist in the implementation of construction. The written scope of work will be reviewed with the Contractor and signed by the City and the Contractor prior to commencement of the work. All construction will be measured and paid at the various Contract Unit Prices in the proposal complete in place as directed by the Engineer. The General Contractor must demonstrate that, in accordance with the requirements of the Bid Documents, ten percent (10%) of the Contract, if awarded, must be expended for Minority Business Enterprises (MBE) and 5% for Women Business Enterprises (WBE), unless the General Contractor qualifies as a duly recognized Minority Business Enterprise in his own right. In addition to MBE requirements, 10% of the work force shall be minority employees of the General Contractor. SDO (Supplier Diversity Office) Certified Business Enterprises are acceptable for compliance with the 10% MBE Contract expenditure requirement. No Bidder may withdraw his bid for a period of thirty (30) days, excluding Saturdays, Sundays and legal holidays, after the date set for the opening thereof. The Bidders attention is directed to the time of completion of the work as set forth in the Information for Bidders. The successful Bidder will be required to furnish and pay for a Performance Bond (100%) and also Labor and Material or Payment Bond (50%), each of a surety company qualified to do business under the laws of the Commonwealth and satisfactory to the City of Brockton, the first in the sum of one hundred percent (100%) of the Contract Price, and the second in the sum of fifty percent (50%) of the Contract Price. Bonds will be required for each purchase order issued during the life of the Contract. The City of Brockton reserves the right to reject any or all bids or to waive any informality in the bidding, if it is in the City of Brockton interest to do so. Bids may be held by the Brockton Department of Public Works for a period not to exceed sixty (60) days from the date of the opening of bids for the purpose of reviewing the bids and investigating the qualifications of the Bidders, prior to awarding of the Contract.
