Preventative Maintenance and Emergency services as specified by manufacturer with emergency service for chillers located at VAMC, Franklin R Sousley Campus, Chiller Plant, Building 67, Lexington, Kentucky per the Statement of Work. Contract Period: Option 3 POP Begin: 10-01-2025 POP End: 09-30-2026 PRINCIPAL NAICS CODE: 238220 - Plumbing, Heating, and Air-Conditioning Contractors PRODUCT/SERVICE CODE: J041 - Maintenance, Repair, and Rebuilding of Equipment - Refrigeration, Air Conditioning, and Air Circulating Equipment 3 TERMS AND CONDITIONS The Contractor agrees to the following terms of a Blanket Purchase Agreement (BPA) EXCLUSIVELY WITH the Department of Veterans Affairs: B.4 ADMINISTRATIVE DATA A Blanket Purchase Agreement (BPA) is hereby established between and the Department of Veterans Affairs under the following terms and conditions incorporated in this BPA: Primary Point of Contact: Alternate Point of Contact: UNIQUE ENTITY IDENTIFIER (SAM): Cognizant Office (Include complete address): Department of Veterans Affairs Network Contracting Office 9 (90C) NCO 9 1639 Medical Center Parkway, Suite 400 Murfreesboro TN 37129 B.5 OPTION TO EXTEND THE TERM OF THE BPA The Government may extend the term of this BPA by written notice to the Contractor prior to the expiration of the BPA, in accordance with FAR 52.217-8, provided that the Government shall give the Contractor a preliminary written notice of its intent to extend at least 30 days before the BPA expires. The preliminary notice does not commit the Government to an extension. The extension cannot exceed a 6-month time frame starting from the BPA expiration date of 09/30/2027. B.6 GENERAL SERVICES ORDERS a. The BPA holder shall furnish all the necessary qualified personnel, materials, facilities, and management resources to furnish the services set forth in the Statement of Work (SOW). b. It is understood and agreed that the BPA holder shall provide Fixed-Price quotes when requested by the Contracting Officer (CO). The contractor's quote shall be priced using labor rates and labor categories here in provided. The CO will issue Fixed Priced Orders upon completion of negotiations of contractor quotes. B.7 NONPERSONAL SERVICES a. In performance of this contract, the BPA holder will provide services as required by program offices to support management of their overall mission. This will be based upon the order's performance work statement for the specific effort. Orders will be formally issued to the BPA holder as opposed to individual BPA holder employees. b. The services required under the Agreement constitute professional and management services within the definition provided by FAR 37.201. Under this Agreement the Government will obtain professional services, which are essential to the Department of Veterans Affairs mission but not otherwise available within Department of Veterans Affairs. c. The Government will neither supervise BPA holder employees nor control the method by which the BPA holder performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual BPA holder employees. It shall be the responsibility of the BPA holder to manage their employees and to guard against any actions that are of the nature of personal services, or give the perception of personal services. If the BPA holder feels that any actions constitute, or are perceived to constitute personal services, it shall be the BPA holder's further responsibility to notify the Contracting Officer immediately. d. These services shall not be used to perform work of a policy/ decision making or management nature. All decisions relative to programs supported by BPA holders will be the sole responsibility of the Government. Support services will not be ordered to circumvent personnel ceilings, pay limitations, or competitive employment procedures. B.8 AUTHORIZED LIMITS The Government estimates, but does not guarantee, that individual BPA Orders placed against this Agreement may reach the authorized ceiling limit. The authorized Ceiling Limit of the Agreement is for the period covered by the Agreement; this ceiling is also not a guarantee. The Ceiling Limit of this agreement will be $900,000.00 to account for unforeseen emergency repairs. PERIOD OF PERFORMANCE This BPA period of performance is 10/01/2022 through 09/30/2027. This is a continuous period of performance; however ordering periods are offered as a means for the contractor to provide periodic price increases as necessary. There are no official option years on a BPA. Base Ordering Period: 10/01/2022 through 09/30/2023 Ordering Period 1: 10/01/2023 through 09/30/2024 Ordering Period 2: 10/01/2024 through 09/30/2025 Ordering Period 3: 10/01/2025 through 09/30/2026 Ordering Period 4: 10/01/2026 through 09/30/2027 B.11 AUTHORIZED INDIVIDUALS Individuals Authorized to Place Orders: DVA authorizes the following entities to place orders: Department of Veterans Affairs authorizes the following entities to place orders: NCO-09 Contracting Officers B.12 ORDER FORMAT Orders will be placed against this BPA via SF 1449. Each individual BPA Order will describe the tasks, services and deliverables required. (e) SITE VISIT: Quoters who wish to visit the site may meet with the Contracting Officer Representative (COR) Kevin Burke, he can be contacted at (859) 233-4511 ext. 3378 or by email at Kevin.Burke2@va.gov . Site visits shall be conducted on August 19, 2022, starting at Noon to 4:30pm Eastern at the Sousley Campus. The street address is 2250 Leestown Road, Lexington KY 40511. Once the tour of the equipment has concluded at the Sousley Campus, Kevin Burke will provide a map with directions to the Troy Bowling Campus. As stated above, the site visit will begin at the Sousley Campus first and will then continue on to the Bowling Campus. Contractor Questions/Government Answers Can you point me in the right direction for the bid results and previous RFP for the last time this contract went out for bid. Government Answer To clarify this is a Request for Quote (RFQ) in accordance with FAR Part 13 procedures. The last time the requirement was solicited, an RFQ was issued in accordance with FAR Part 13 procedures. A Request for Proposal (RFP) indicates the procurement will be awarded following FAR Part 15 procedures AND THAT IS NOT WHAT IS BEING REQUESTED FOR THIS CONTRACT NOR THE ONE CURRENTLY IN EXISTANCE. The previous contracts were issued in 2 separate actions one for the Bowling Campus and one for the Sousley Campus as outlined below: On October 1, 2017, contract VA249-18-C-10314 was awarded to Johnson Controls Inc having a total contract value of $173,604.00 for services at the Sousley campus only. The contract will expire on 09/30/2022. On October 1, 2017, contract VA249-18-C-10312 was awarded to Johnson Controls Inc having a total contract value of $270,600.00 for services at the Bowling campus only. The contract will expire on 09/30/2022. Who is the incumbent contractor. Government Answer Johnson Controls, Inc. What was the previous award amount or contract number. Government Answer Please see the answer to question #1 above. Steven mentioned cleaning cooling towers as part of the preventative maintenance at the bowling site but said he didn t think he added it to the solicitation. After reviewing the contract again, I do not see any mention of this. Any clarification on this matter will be greatly appreciated. Government Answer Cleaning Cooling Towers is not a requested service to be included in this contract and was mentioned in error.
