The City of Boston, acting by and through its Boston Public Schools Department of Facilities Management at 1216 Dorchester Avenue, Dorchester, MA 02125, invites sealed bids for the above-entitled project. The project is subject to all applicable provisions of law including, without limitation, sections 39f and 39k through 39p of Chapter 30, and sections 29 and 44A to 447, inclusive of Chapter 149 of General Laws, as amended, and in accordance with the terms and provisions of the contract documents entitled: On Call Asbestos Removal and Abatement at various Boston Public Schools (the contract). This contract is for one (1) year with an option to renew the contract for up to two (2) additional one-year terms at the sole discretion and authority of the awarding authority. For purposes of contracting the provision of time, labor, materials, services, and equipment for On Call Asbestos Removal and Abate- ment at various Boston Public Schools, the City of Boston Public Schools has been divided into three (3) groups of buildings. Two groups have already been awarded and we are looking for a vendor to award the third group. Vendors who have been awarded Group 1 and Group 2 are not eligible to be awarded the contract for Group 3. The scope of work is detailed in the bid package. General contractors must file with their bids (1) a copy of a valid certificate of Eligibility showing that they are eligible to bid on projects up to the project amount and up to an aggregate limit, and (2) a completed and signed Update Statement summarizing the contractors record for the period between the latest DCAMM certification and the date of the contractor submit its bids. Bids must be accompanied by a bid deposit in the form of a certi- fied check drawn on, or a treasurers or cashiers check issued by, a responsible bank or trust company, payable to the City of Bos- ton, or a bid bond of a surety company qualified to do business in Massachusetts and satisfactory in form to the Awarding Authority. The amount of such check and the penal sum of such bond shall be a sum equal to five (5) percent of the bid. The attention of all bidders is specifically directed to the equal employment opportunity section of the specifications and the obli- gation of the contractor and all subcontractors to take affirmative action in connection with employment practices throughout the work. Contractors are hereby notified that pursuant to M.G.L. c. 149, sections 26 to 27G, contractors must pay prevailing wages as established by the Massachusetts Department of Labor and Work- force Development/Division of Occupational Safety. LABOR HARMONY: All Bidders must certify that they are able to furnish labor that can work in harmony with all other elements of labor employed or to be employed at work; OSHA TRAINING: All Bidders must certify that all employees to be employed at the work site will have successfully completed a course in construction safety and health approved by the United States Occupation Safety and Health Administration (OSHA) that is at least 10 hours in duration at the time the employee begins work and who shall furnish documentation of successful comple- tion of the said course with the first certified payroll report for each employee OSHA MGL 30-39s: All Bidders must certify that all employees to be employed in the work subject to this bid have successfully com- pleted a course in construction safety and health approved by the United States Occupation Safety and Health Administration (OSHA) that is at least 10 hours in duration. A performance bond, and also a labor and materials payment bond, of a surety company, qualified to do business under the laws of the Commonwealth and included in the U.S. The Awarding Authority reserves the right to waive any minor in- formalities or to reject any and all bids, or any part or parts there- of, and to award a contract as the Awarding Authority deems to be in the best interest of the City of Boston and the Boston Public Schools. The award of any contract shall be subject to the approval of the Superintendent of Schools and the Mayor of Boston.
