The County, choosing to exercise its right of rejection, does so without imposition of any liability against the County. It is the responsibility of the Contractor to verify all pricing and to modify their adjustment factors according to inflation or material cost fluctuations prior to submitting a final Base Bid price. PROJECT LOCATION: Rickenbacker Causeway - Hobie Island North, FL 33129 PRIME CONTRACTOR LICENSE AND EXPERIENCE REQUIREMENTS: License Requirement: PRIMARY: General Contractor, General Engineering SUB: Electrical, and Plumbing Experience Requirement: The Prime Contractor, through full time-personnel, should demonstrate experience as the prime consultant on similar projects with project scopes that are comparable to the Project Scope of Services for this project. A preferred minimum of three (3) of these projects are preferred to have been completed within the last ten (10) years. Bidders lacking this experience may be deemed non-responsible in the sole discretion of the County. SCOPE OF WORK: (Contractor must obtain and submit all permits prior to performing any work.) CONTRACTOR shall review all documents, specifications, plans and scope of work provided by Miami-Dade County Parks, Recreation, and Open Spaces Department for work to be completed. This Rickenbacker Causeway shoreline area is located mostly on Hobie Island north side (facing downtown Miami), between the West Bridge and the William Powell Bridge. This roadway protection and shoreline improvement project includes shoreline stabilization, beach renourishment, new seawalls, new storm water management system, new pavement for parking and parkways, new paved bike lanes and trails, new paver walkways, guardrails, and new extensive landscapes in upland area. It also includes removal of invasive vegetation, clearing and grubbing, removal of retaining wall and concrete berm south side of Hobie Island along the Rickenbacker Causeway frontage road eastbound. CONTRACTOR is hereby advised that permits are an essential part of the Contract Documents. Note that work is further described in the contract documents and within the plans. All Addenda for this project will be available within the same link emailed for the Bid Documents. It is the Bidder's responsibility to ensure receipt of all addenda, and any accompanying documentation. Acknowledgment of bid documents and addenda received by Bidders is a requirement when submitting Bids. Failure to return signed receipts as part of your Bid Submittal may deem the bid non-responsive. Each Bid must be accompanied by a certified check or acceptable bid bond in the amount of five percent (5%) of the proposed total bid amount as guarantee that the Bidder, if awarded the Contract, will provide, as set forth in the Bid Documents, a Performance and Payment bond satisfactory to Miami-Dade County, Parks, Recreation and Open Spaces Department, equal to one hundred (100%) percent of the total Contract award amount. Bidders may not withdraw their bids for a period of one-hundred and eighty (180) calendar days after the bid opening, after which they may be requested to extend their bids until either a Recommendation for Award or a Notice of Rejection of Bids has been filed with the Clerk of the Board, Miami-Dade County. Failure to hold prices shall be cause to render the bid non-responsive and risk forfeiture of the bid bond as liquidated damages. Verbal statements made by the County or the Owner's Representative that are not contained in an RPQ or addendum to the RPQ are not binding on the County and should not form any basis for a bidder's response to an RPQ. n accordance with Miami-Dade County Ordinance No.'s 97-52 and 97-158; I.O. 3-22, an SBE-Construction Subcontractor (SBE-Cons) no measure goal has been established and an SBE-Service Subcontractor (SBE-S) goal of 10.65% has been established. COMMUNITY WORKFORCE PROGRAM: In accordance with Dade County Ordinance No. 03-01 as amended, the Community Workforce Program (CWP) is not applicable for this project. EMPLOY MIAMI-DADE PROGRAM: In accordance with Section 5.02 of the Miami-Dade County Home Rule Amendment and Charter, Section 2-8.1 of the Code of Miami-Dade County, and Administrative Order No. 3-63, all contractors and subcontractors of any tier on (i) construction contracts valued in excess of one million dollars ($1,000,000) for the construction, demolition, alteration and/or repair of public buildings, or public works; or (ii) contracts or leases valued in excess of one million dollars ($1,000,000) for privately funded construction, demolition, alteration or repair of buildings, or improvements on County-owned land. The awarded Contractor is hereby notified that the County will consider whether the Contractor made its best reasonable efforts to promote Employ Miami-Dade on this contract, as defined in A.O. 3-63, as part of the County's evaluation and responsibility review of the Contractor for new County contract awards. RESIDENT FIRST TRAINING AND EMPLOYMENT PROGRAM: In accordance with Section 2-11.17 of the Code of Miami-Dade County and Implementing Order No. 3-61, all contractors and subcontractors of any tier on (i) construction contracts valued in excess of $1 million for the construction, demolition, alteration and/or repair of public buildings, or public works; or (ii) contracts or leases valued in excess of $1 million for privately funded construction, demolition, alteration or repair of buildings, or improvements on County-owned land shall comply with the following: (i) prior to working on the project, all persons employed by the contractor or subcontractor on the project to perform construction have completed the OSHA 10- hour safety training course, and (ii) the contractor will make its best reasonable efforts to have 51% of all construction labor hours performed by Miami-Dade County residents. COLLUSION AFFIDAVIT: Pursuant to Section 10-33.02.1 of the Miami-Dade County Code, bidders on County construction contracts are requested to complete and submit the Collusion Affidavit form included with the Bid Documents. Any person or entity that fails to submit the required affidavit in accordance with the aforementioned Code shall be ineligible for contract award. Failure to provide a Collusion Affidavit prior to Recommendation for Award may be cause for the Contractor to be deemed non-responsive and forfeit their bid/proposal bond. CONE OF SILENCE: Pursuant to Section 2-11.1(t) of the County Code and Administrative Order 3-27 ("Cone of Silence Provisions"), as amended, a "Cone of Silence" is imposed upon RFPs, RFQs, or bids after advertisement and is lifted at the time the project has been Recommended for Award. Written communications may be submitted via e-mail to Jeffery Becar at Jeffery.Becarcavero@miamidade.gov and copy the Clerk of the Board at CLERKBCC@miamidade.gov. The County shall respond in writing and file a copy with the Clerk of the Board, which shall be made available to any person upon request. DISCLOSURES: In accordance with Miami-Dade County Implementing Order 3-9, Accounts Receivable Adjustments, if money is owed by the Contractor to the County, whether under this Contract or for any other purpose, the County reserves the right to retain such amount from payment due by County to the Contractor under this Contract. Such retained amount shall be applied to the amount owed by the Contractor to the County. The Contractor shall have no further claim to such retained amounts which shall be deemed full accord and satisfaction of the amount due by the County to the Contractor for the applicable payment due herein. VERIFICATION OF EMPLOYMENT ELIGIBILITY (E-VERIFY): By entering the Contract, the Awarded Bidder becomes obligated to comply with the provisions of Section 448.095, Florida Statute, titled "Verification of Employment Eligibility." This includes but is not limited to utilization of the U.S. Department of Homeland Security's E-Verify System to verify the employment eligibility of all newly hired employees by the Awarded Bidder effective, January 1, 2021, and requiring all Subcontractors to provide an affidavit attesting that the Subcontractor does not employ, contract with, or subcontract with, an unauthorized alien. Failure to comply may lead to termination of this Awarded Bidder, or if a Subcontractor knowingly violates the statute, the subcontract must be terminated immediately. Any challenge to termination under this provision must be filed in the Circuit Court no later than twenty (20) calendar days after the date of termination. If this Contract is terminated for a violation of the statute by the Awarded Bidder, the Awarded Bidder may not be awarded a public contract for a period of one year after the date of termination, and the Awarded Bidder may be liable for any additional costs incurred by the County resulting from the termination of the Contract. Public and private employers must enroll in the E-Verify System (http://www.uscis.gov/e-verify) and retain the I-9 Forms for inspection."
