This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. Solicitation number 140R6022Q0071 is issued as a request for quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2022-07 effective August 2022. This is a total small business set aside under NAICS 541350 with an associated small business size standard of $8 Million Vendors will be required to submit required documentation listed in FAR 52.212-2 to allow for best value evaluation as per the clause. Vendors will be required to sign 52.204-24. A fully copy of the combined synopsis/solicitation along with an excel spreadsheet for convenience in quoting is provided with this announcement as attachments. Please ensure submission of all requirements as noted below. Statement of Work Scope of Work: The contractor shall furnish all personnel, management, equipment, tools, and labor necessary to inspect the elevators and perform the detailed tasks listed below within the jurisdiction of the Wyoming Area Office, Mills, Wyoming in a manner that will ensure continuous and safe operation. This purchase order is a base year with 4 optional years. This purchase order will only require the contractor to perform inspections and tests once annually on each elevator listed and optional year #1 will require performing Category 5 periodic tests. Any request to work outside of the facility operations hours shall be subject to the approval of the Contracting Officer. Periodic Inspections and Category 1 Tests for years base year and option years 2,3, & 4 -Periodic Inspections and Tests: The contractor shall perform periodic inspections and category 1 periodic tests for all elevators in accordance with ASME A17.1-2019, Section 8.11, Periodic Inspections and Tests, and Appendix N, Table N-1, Recommended Inspection and Test Intervals, ASME A17.2-2020, Guide for Inspection of Elevators, and Moving Walks; and ASME A17.3-2020, Safety Code for Existing Elevators and Escalators. Periodic Inspections and Category 5 test for optional year 1 -Periodic Inspections and Category 5 test: The contractor shall perform periodic inspections and category 5 tests for all elevators in accordance with ASME A17.1-2019 Section 8.11, Periodic Inspections and Tests, ASME A17.2-2020, Guide for Inspection of Elevators, and Moving Walks; and ASME A17.3-2020, Safety Code for Existing Elevators and Escalators. Tasks to be Performed at Pathfinder Dam Annually -Resocketing of Pathfinder Dam Elevator Hoisting Ropes: The contractor shall perform the resocketing of the hoisting ropes for the Pathfinder Dam Elevator in accordance with ASME A17.1-2019, Section 8.6.4.10. -Pathfinder Dam Elevator Safeties Test: The Pathfinder Dam Elevator does not have a governor for setting the car safeties. Therefore, the required procedure for testing the car safeties is outlined as follows: a) Open the gates in the chain-link fence that spans the top of the dam to access the car safeties. b) Hold the elevator car with come-a-longs or chain hoists and rigging of the proper rated load. (Hoisting equipment and rigging shall have a minimum rating of 5 tons) c) Slacken the elevator car hoist cables. d) Slacken the come-a-longs or chain hosts. As these are slackened, the safeties will run out to grip the rails to stop and hold the car for the test to be valid. e) Return the elevator car to its normal operating status, i.e., the safeties returned to their normal position, the come-a-longs or chain hoists removed, and the hoist holding the car. f) Close the gates accessing the car safeties. g) Note: Slackening the hoist cables with the car resting at the bottom of the elevator run is NOT an acceptable test of the elevator safeties, as there is no way to be sure that the safeties will stop the car. Deliverables: The contractor shall prepare and submit three copies of each test report, type written, showing that all the tests required by ASME A17.1-2019 Section 8.11, Periodic Inspections and Tests, were performed. Test reports are to be submitted within 60 days of completion of work to the Bureau of Reclamation, P.O. Box 1630, Mills, WY 82644, Attention: WY-5301. The reports must include a certification statement such as: I certify that all tests, checks, and inspections required by ASME A17.1-2019, Section 8.11 for Periodic Inspections and Category 1 Periodic Tests were performed on date(s). This statement must be signed by the person responsible for the tests. An additional statement is required for the Pathfinder Dam elevator to certify that the hoisting cables were resocketed, by whom (person(s) and company name) and the date. Within 10 calendar days following Notice of Award, the contractor shall submit a schedule, by email to bpindell@usbr.gov. No work is to be done until the acceptance of the contractors schedule. In the event an elevator is found in need of immediate repairs or parts replacement and the failure to make these repairs could lead to an unsafe or defective condition, the contractor shall notify the Contracting Officers Representative (COR) immediately. The COR will then work with the Contracting Officer to determine if the repairs are within scope or out of scope. If the repair is out of scope the vendor shall NOT perform the work until a separate purchase has been approved. Contractor Qualifications, Security and Safety: Contractor employees shall comply will all federal, state, and local laws. The qualified elevator mechanic must hold a valid elevator mechanics license to perform the specified work. A company certification/license will not be acceptable. A copy of the proposed mechanics license must be submitted with the bid to the purchasing agent. Failure to submit a copy shall be grounds for disqualification of the quote. The contractor and their employees shall be restricted to those areas necessary to perform work under this contract as well as direct routes to and from the work site as approved by Byron Pindell. All supplies, equipment, and machines shall be kept out of traffic lanes or other areas where they might create a public hazard. The contractor shall remove and dispose of, to an off-site location, all debris resulting from work performed under this contract. Period of Performance: It is estimated that the contract will be awarded, and performance will begin on 9/1/2022 and continue through 8/31/2023, and the government will reserve the right to exercise up to 4 option periods as the needs of the government and funding allow. Pricing: Pricing shall include all costs, including mobilization/demobilization and shall be on an hourly rate with an NTE cost for the entire project. A copy of the excel spreadsheet will be attached to this announcement for administrative convenience. Clauses and Provisions: The provision at 52.212-1, Instructions to Quoters-Commercial applies to this acquisition. Addendum to 52.212-1 substitutes the term quote where the term offer appears in the provision. 52.212-2 EVALUATION-COMMERCIAL ITEMS (OCT 2014) (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers: This requirement will be evaluated on a best value basis. The vendor shall supply the following items to determine best value: 1. Technical Capability, the vendor shall provide a project management plan, proper certifications, and a schedule. 2. Past Performance, the vendor shall provide 3 references of the same/similar work completed in the last 5 years. Past performance can also be evaluated on personal knowledge of the contractor's work as well as surveys of CPARS and FAPIIS for contract work done in the past. 3. Price Additionally, past performance and technical ability are considered equal in importance to each other. Technical and past performance, when combined, are considered more important when compared with price. (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offers specified expiration time, the Government may accept an offer (or part of an offer), whether there are negotiations after its receipt, unless a written notice of withdrawal is received before award. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3. (a) Definitions. As used in this provision Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment. (b) Prohibition. (1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to (i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or (ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles. (2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a federal contract. Nothing in the prohibition shall be construed to (i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or (ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles. (c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services". (d) Representation. The Offeror represents that (1) It [_] will, [_] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and (2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that It [_] does, [_] does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. (ii) For covered services (A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or (B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
