BIDS MUST BE ACCOMPANIED BY A BID GUARANTEE ACCORDING TO THE FOLLOWING CONDITIONS: In an amount equivalent to a percentage of the price of the tender and according to the form determined below: A bid bond issued by a financial institution and established in the amount of ten percent (10%) of the price of the bid, valid for a period of forty-five (45) days from the date of opening of the bids; Where A certified check or bank draft made payable to the Project Manager in the amount of five percent (5%) of the bid price; Where An irrevocable letter of guarantee issued by a bank, credit union or trust or savings company and conforming to the provisions of the Project Manager's "Irrevocable Letter of Guarantee" form in the amount of five percent ( 5%) of the bid price. Failure to participate may not serve as an excuse or pretext for errors, omissions or irregularities on the part of a tenderer.
