NOTICE IS GIVEN that the City of Fairfield will receive bids for the furnishing of all labor, materials, transportation and services necessary for the construction and completion of: CDBG LINEAR PARK TRAIL LIGHTING PROJECT This Project includes, but is not limited to, installation of new street light poles, foundations, and housekeeping concrete pad with the removal of existing street light poles, relocation of existing L.E.D. luminaires and replacement of street light conductors as shown on the contract documents. Each bid must be in accordance with the provisions of the contract documents now on file with the City Engineer, City of Fairfield, Fairfield, California, which contract documents are incorporated herein by reference and made a part hereof. This project is partially or wholly financed with City, State and/or Federal (CDBG) funds and accordingly, the Contractor must abide by all Federal, State and local laws and regulations regarding equal employment and other Labor Standard Provisions, including but not limited to: a. Affirmative Action/Non-Discrimination/Equal Employment Opportunity b. David-Bacon and Related Acts c. Federal MBE/WBE and City Business Inclusion programs i. Goals for Minority Participation in each trade is 17.1% ii. Goals for Female Participation in each trade is 6.9% d. HUD Section 3 Resident and Business Concern i. 25% of all labor hours must be performed by a Section 3 worker ii. 5% of all labor hours must be performed by Targeted Section 3 workers e. Federal and State labor standards compliance, including payment of prevailing wages f. Uniform Relocation Act The City of Fairfield hereby affirms that in any contract entered into pursuant to this advertisement, Minority Business Enterprises (MBE) and Women Business Enterprises (WBE) will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award. Pursuant to Section 1773 of the Labor Code, the general prevailing wage rates in the county, or counties, in which the work is to be done have been determined by the Director of the California Department of Industrial Relations. These wages are set forth in the General Prevailing Wage Rates for this project, available at City of Fairfield Public Works Department and from the Attention is directed to the Federal minimum wage rate requirements. If there is a difference between the minimum wage rates predetermined by the Secretary of Labor and the general prevailing wage rates determined by the Director of the California Department of Industrial Relations for similar classifications of labor, the Contractor and subcontractors shall pay not less than the higher wage rate. The Department will not accept lower State wage rates not specifically included in the Federal minimum wage determinations. This includes "helper" (or other classifications based on hours of experience) or any other classification not appearing in the Federal wage determinations. Where Federal wage determinations do not contain the State wage rate determination otherwise available for use by the Contractor and subcontractors, the Contractor and subcontractors shall pay not less than the Federal minimum wage rate, which most closely approximates the duties of the employees in question. This contract is subject to state contract nondiscrimination and compliance requirements pursuant to Government Code, Section 12990. Bid Guaranty and Bonding Requirements are as follows: (a) a bid guarantee in the amount of 10% of the bid price must be submitted with bid proposal, (b) the successful bidder shall furnish a payment bond and a performance bond in the amount of 100% of total bid price. Proof of compliance with insurance requirements (including certificates of insurance and additional insured endorsements) shall be provided by the successful contractor. Coverage shall be for the following amounts: (a) Commercial General Liability - $3,000,000 each occurrence, $6,000,000 each aggregate, (b) Automobile Liability - $1,000,000 each occurrence, and (c) Worker's Compensation/Employer's Liability - $1,000,000 each occurrence. The Contractor shall perform with his/her own organization, work of a value amounting to not less than fifty (50) percent of the remainder obtained by subtracting from the total original value the sum of any items that may be designated as "Specialty Items" in the Special Provisions. Pursuant to the California Integrated Waste Management Act of 1989, Assembly Bill, at least 50% of the waste generated from this construction project, as measured by weight, shall be recycled. Whomever is responsible for collecting and transporting waste stored and/or transported in containers, as defined in Chapter 9 of the Fairfield Municipal Code (section 9.030 "Defined Terms and Phrases"), shall become authorized to do so by entering into a Collection Agreement approved by the City of Fairfield. The collectors and/or haulers of all other waste generated by this project shall not require authorization, but the recycling requirements will still apply and will be monitored for compliance by the City. All public works projects are subject to compliance monitoring and enforcement by the State of California Department of Industrial Relations (DIR). No contractor or subcontractor may be listed on a bid proposal for a public works project unless registered with the DIR pursuant to Labor Code section 1725.5 (with limited exceptions from this requirement for bid purposes only under Labor Code section 1771.1(a)). Furthermore, no contractor or subcontractor may be awarded a contract for public work on a public works project unless registered with the DIR pursuant to Labor Code section 1725.5.
