Sealed Bid Proposals will be received by Schneider Electric who has been selected as the Energy Services Company (ESCO) for: Project: Energy Savings Improvement Program (ESIP): For the Customer: Willingboro Municipal Utilities Authority (WMUA), in accordance with the Drawings, Specifications, and Bid Documents as prepared by Schneider Electric. Neither WMUA nor Schneider Electric will assume any responsibility for bids mailed or misdirected in delivery. No bid may be withdrawn for a period of ninety (90) days from the day of the bid opening. Any bids received after the closing time will be returned unopened. In order to be considered, bids must be received in a sealed envelope and the outer envelope must be clearly marked specifying the Project and the appropriate Prime Bid. Schneider Electric reserves the right to reject any or all bids and waive any informality in the bidding process in accordance with the law if it is in the best interest of Schneider Electric and/or the district. The Contract, if awarded shall be awarded to the lowest responsible bidder whose bid is responsive in all material respects to the bid requirements and is in the best interest of the customer and of Schneider Electric. No bid shall be deemed accepted until the adoption of a formal subcontract by Schneider Electric. All bidders must use and complete all bid forms provided in the manner designated and must comply with every requirement contained in the instruction and specifications. Bid responses shall be marked in a sealed envelope with the name of the project plainly marked on the front of the envelope and accompanied by a bid guarantee in the form of a certified check or Bid Bond in the amount of 10% of the bid, but not to exceed $20,000 pursuant to N.J.S.A 18A:18A-24. All applicable surety bonds required in connection with the advertisement and award of building contracts or subagreements must be written by a surety company listed on the Federal Treasury List (Department Circular 570-Surety Companies Acceptable on Federal Bonds), incorporated herein by reference in accordance with N.J.A.C. 7:22-3.17(g). This subcontract is expected to be funded in part with funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust.
