For the project identified on the PORT OF EPES INDUSTRIAL PARK DREDGING DISPOSAL PLAN This project (EDA Investment No. 04-01-07492) will be partially funded with Federal funds from the United States Department of Commerce, Economic Development Administration and therefore is subject to the Federal laws and regulations associated with that program. BIDS must be submitted on PROPOSAL forms furnished in SPECIFICATIONS. All BIDDERS bidding in amounts exceeding $50,000.00 must be licensed under the Provision of Title 34, Chapter 8, Code of Alabama, 1975. No BID may be withdrawn after the scheduled closing time for receipt of BIDS for a period of ninety (90) days. The OWNER reserves the right to reject any or all PROPOSALS and to waive technical errors if, in the ENGINEER'S judgment, the best interest of the OWNER will thereby not be promoted. BIDS shall be accompanied by a BID guarantee of no less than five percent (5%) of the base BID, but in no event more than $10,000, which may be a BID BOND or certified check made payable to the OWNER. BID BONDS are to be issued by an acceptable bonding company licensed to do business in the State, with a Power of Attorney, to confess judgment thereon, with the understanding that it shall guarantee that the BIDDER shall not withdraw his BID for a period of ninety (90) days after the scheduled closing time for the receipt of BIDS; that if his BID is accepted, he will enter into a formal CONTRACT with the OWNER, and that in the event of a withdrawal of said BID within said period, or the failure to enter into said CONTRACT within the time specified, the BIDDER shall be liable to the OWNER for the full amount of the BID guarantee as liquidated damages and not as a forfeit or as a penalty. The BID BOND and/or certified check on unsuccessful BIDDERS will be returned upon awarding the CONTRACT or rejection of all BIDS, in no event, later than thirty (30) days from the opening of PROPOSALS. That of the successful BIDDER will be returned when formal CONTRACT and BONDS are accepted and approved.
