Carl T. Mitnick School, Maud Abrams School, Memorial School and Sandman Consolidated School 2023 HVAC Renovations. It is expressly understood that the Bidder is responsible for getting the bid to the Business Administrator prior to the time and date set for the bid opening. Bids shall be addressed to the Owner whose name appears in Paragraph 1a of the Instructions to Bidders; it shall be mailed or delivered to the address stated herein, enclosed in an opaque sealed envelope, marked with the name of the Project and Bidder as described in the Notice to Bidders ; and must be received by not later than the time designated in the Advertisement. No responsibility will attach to Architect or Owner for premature opening of a bid which is not properly identified. Any bid received after the closing time will be returned unopened. In order to be considered, bids must be sealed, with the outer envelope clearly marked with the name of the Bidder and the following Carl T. Mitnick School, Maud Abrams School, Memorial School and Sandman Consolidated School 2023 HVAC Renovations. The Bidders are requested to submit, in accordance with N.J.S.A. 18A:18A-18(b)(2), one Lump Sum Bid for all the work and materials. Bidders and/or their Prime Subcontractors must be pre-qualified by the New Jersey Department of Treasury, Division of Property Management and Construction (DPMC) in each of the following categories, pursuant to N.J.S.A. 18A:18A-26 et seq.: C008 General Construction or C009 General Construction / Alterations and Additions; C029 Structural Steel and Ornamental Iron; C032 HVACR; C030 Plumbing; and C047 Electrical. The Bidder and named Prime Subcontractors, defined as those listed in N.J.S.A. 18A:18A-18, listed must be pre-qualified prior to the date that bids are received. Bids must be accompanied by a certified check, bank cashier's check, treasurer's check or Bid Bond in the form provided in the Contract Documents, with corporate surety satisfactory to the Owner, in an amount of 10% of the Base Bid (but in no case in excess of $20,000.00, pursuant to N.J.S.A. 18A:18A-24), naming as payee or obligee, as applicable, The Board of Education of the Township of Lower, to be retained and applied by the undersigned as provided in the Contract Documents in case the successful Bidder defaults in executing the Agreement or furnishing the bonds and insurance certificates as required by the Contract Documents. Prospective Bidders are advised that this Project is one which will be subject to and will be governed by provisions of New Jersey laws governing (a) Prequalification of Bidders N.J.S.A. 18A:18A-26 et seq.; (b) Prevailing Wage Rates N.J.S.A. 34:11-56.27; (c) Use of Domestic Materials, N.J.S.A. 18A:18A-20 (d) Ownership Disclosure Certification N.J.S.A. 52:25-24.2; and (e) disclosure of investment activities in Iran, pursuant to N.J.S.A. 18A:18A-49.4 in accordance with to N.J.S.A. 52:32-57, et seq. The Public Works Contractor Registration Act N.J.S.A. 34:11-56.48 et seq. requires that the Bidder and Named Prime Subcontractors must be registered at the time of Bid. The Owner is requesting that copies of the Certificates be included in the Bidder's Bid Package, but Bidder must provide copies of the Certificates no later than the time of award. Pursuant to N.J.S.A. 52:32-44 all business organizations that do business with a local contracting agency are required to be registered with the State and provide proof of their Registration with the New Jersey Department of Treasury, Division of Revenue before the contracting agency may enter into a contract with the business. In addition, and pursuant to N.J.S.A. 18A:18A-25, each bid must be accompanied by a certificate from a surety company stating it will provide said Bidder with a bond in such sum as required by the above referenced statute. No bid may be withdrawn for a period of sixty (60) days after the dates set for the opening thereof. The right is reserved to reject all bids pursuant to N.J.S.A. 18A:18A-22 or to waive minor informalities or non-material exce-ptions. Bidders are required to comply with the provisions of N.J.S.A. 10:5-31et seq. and N.J.A.C. 17:27 et seq. The Board of Education recognizes its obligation as it pertains to the Stevens Amendment, Section 8136 of the Department of Defense Appro-priations Act (P.L. 104-134, Sec.507) which requires the board of education to state clearly the percent of the total cost of this project which will be financed through funds provided under the Elementary and Secondary School Emergency Relief Fund ("ESSER"). The Board anticipates that approxi-mately $2,833,768.00, representing approximately 15% of the estimated total cost of the HVAC Renovations Project, will be financed with Federal Funds. In addition to the legal requirements set forth herein, this project is subject to numerous requirements for federally funded contracts, which are set forth in greater detail in the Bid Documents. Contractors will be obligated to adhere to both New Jersey and federal law, and to abide by the more stringent law wherever there is conflicting authority. No work can be started until all permits are received. The existing school must be completely operational during the school year. This entire project MUST be completed on or before September 1, 2023. All construction preparation work, project startup, submittals, schedules, approvals, procurement, coordination and other preparatory tasks must commence immediately upon receipt of the Notice to Proceed or the date of the fully executed Owner/Contractor Contract, whichever comes first. The Awarded Contractor must be fully prepared to deliver and install all materials and equipment on the first day of the scheduled On-Site Construction period. The On-Site Construction period is to start during the Summer Break which is currently scheduled to start on or about June 20, 2023 and all work MUST be completed on or before September 1, 2023. Access to the School is available during School Breaks (Winter and Spring), but must be coordinated with the Construction Manager / Owner. The Contractor will be permitted to start work after school hours in the existing schools prior to Summer Break that does not affect the continuing occupancy of the building. This work must be coordinated with and approved by the Construction Manager / Owner. It is anticipated that the Summer work will require ten (10) hour days, weekends and holidays in order to meet the construction schedule. Any work performed after the Contract completion date must be accomplished after school hours, on weekends and holidays. No additional compensation will be provided. A wing of the Carl T. Mitnick School (15 classrooms) will be used for the District's Summer School Program. The work in this wing cannot commence before August 5, 2022 and must be complete on or before September 1, 2022. These rooms must be fully functional with working air conditioning during the Summer School program. The front wing of the Carl T. Mitnick School and the entire Memorial School must be completed by August 20, 2023 for student orientation. E. The Work will be constructed under one lump sum prime contract
