Limestone Creek and Muddy Creek Watershed Project The Duplin County Board of Commissioners is seeking proposals for maintenance repair work on Laterals and Drainage ways within the Limestone Creek and Muddy Creek Watershed Project areas in Duplin County, North Carolina. The maintenance repair work includes repair/replacement of pipes/culverts; sediment dip out; hauling/placement of fill dirt and rock rip rap; grading, shaping, fertilizing, seeding, netting and mulching of sites; mowing of vegetation and removal of debris as necessary. Work sites will be coordinated/prioritized with Duplin County Soil and Water Conservation personnel (Inspectors) and prior to beginning work. All work must be completed by February 28, 2023 or liquidated damages will be assessed at a rate of $200 per day. Additionally, the proposal should inciude: A certificate of general liability insurance in the amount of one-million dollars ($1,000,000) with Duplin County as an additional insured. NOTE: _If explosives are to be used at any time during this contract period. the requirement for general liability insurance is increased to the amount of two-million dollars ($2.000.000): with Duplin County named_as additional insured.Proof of worker's compensation insurance; a list of any employees that may be used on the job (this list will be the only time to name any employees; a list of references; a detailed list of the equipment that the employees will be using on the job; a letter of intent from your performance bond company; W-9 Form; Affidavit of Compliance- E-verify Form; Certificate of No Past Due Taxes; Certification regarding Debarment and Suspension; 11) Non-Collusion Affidavit; 12) HUB Certified Minority Business Participation. Late proposals will be deemed invalid and returned unopened to the provider. Faxed or e-mailed proposals will not be accepted. Any information given verbally or by telephone will be considered informal. Any questions received prior to the deadline which the County feels are pertinent to all Proposers will be mailed as an addendum to this Request for Proposal. A Provider may withdraw its proposal prior to the time that proposals are due by sending a written request to 165 Agriculture Drive, Suite B in Kenansville or_billy.ivey@duplincountync.com, No proposal may be withdrawn after the scheduled closing time for receipt of proposals for a period of 90 days. Any changes or modifications to this Request for Proposal will be transmitted in writing through an addendum. It will be the responsibility of the Proposer to ensure that all addenda are received. The County encourages participation by small, minority, and woman-owned businesses. Duplin County reserves the right at its sole discretion to waive any informalities, to reject any and/or all proposals, and to accept any proposal which in its opinion may be in the best interest of the County. It is preferred that the provider have a minimum of five (5) years' experience in this field. The successful Provider expressly warrants that all services specified in this Request for Proposal will be performed with skill, care, and diligence and in accordance with all requirements under the Request for Proposal. The successful Provider agrees to correct any deficiencies in its provision of services upon notification by the County and without additional expense to the County. The successful bidder will be required to execute a contract. Performance Bond: The successful bidder will be required to furnish and deliver to the County a Performance Bond in the amount of 100% of the contract cost to cover the faithful performance and completion of the scope of work included in this RFP and payment for all materials and labor furnished or supplied in connection with the required work. The bonds shall be issued and furnished to Duplin County prior to, and as a condition precedent to, commencement of the work. The amount of the bonds shall be increased at such times as the contract amount is increased in order to ensure that the amount of the bonds correspond with the contract amount at all times. The performance and payment bonds shall continue throughout the course of the required work and for one year after the full scope of work is completed. The bonds shall be executed by one or more surety companies legally authorized to do business in the State of North Carolina and must be in the form set forth in N.C.G.S. 44A-33 without any variations there from. The Contractor will be solely responsible for any costs associated with obtaining bonds; bond premiums will not be reimbursed by the County. In addition, the successful bidder will be required to submit a verification letter annually from the surety confirming that the Contractor is able to provide a payment and performance bond. Contractor shall provide the County an original Certificate of Insurance indicating that Contractor has in force the required coverage prior to the start of any Services under this Contract and agrees to maintain such insurance until the completion of this Contract. All insurance policies shall be with insurers with an acceptable rating, registered and licensed to do business in the State of North Carolina. Each policy shall provide a thirty (30) day notification clause in the event of cancellation, non-renewal or adverse change. In the event the insurance coverage expires prior to the completion of the project, a renewal certificate shall be on file with the County at least fifteen (15) days prior to the expiration date. Failure to maintain the proper insurance will be grounds for termination of contract. The contract will be awarded to the proposal which is most advantageous to the County upon consideration of all applicable criteria. The County specifically reserves the right to reject any or all proposals, without penalty, and not to issue a contract as a result of the Request for Proposals. Any proposal deemed deficient in any regard can be rejected regardless of how it compares with any other bid amount proposed by any other bidder. The County also reserves the right at its sole discretion to waive minor administrative irregularities contained in the proposal. Failure to comply with any of the terms and conditions of this Request for Proposal may result in rejection of the proposal. The County reserves the right to further negotiate specific terms and conditions with the successful bidder. The County of Duplin reserves the right to award a contract to complete some but not all of the listed items. If the contract awarded is to complete less than the listed work items, the contract price will be based on the listed work item prices submitted by the bidder as a result of this request. Further, if the initial contract is to complete less than the listed work items described in this Request for Proposals, additional funds may be allocated in the future to complete some or all of the other work items described in this request for proposals. Any additional funding, if it becomes available, will be added to the initial contract by contract modification upon mutual agreement of the parties, with the additional work to be done by Contractor for a price no greater than that indicated in the original proposal. Each submittal must be accompanied by a notarized affidavit on non-collusion, executed by the Provider or in the case of a corporation, by a duly authorized representative of said corporation. The Non-Collusion Affidavit is provided herein. Contractor will be the primary contractor and will perform the services using their own workforce. Contractor shall not subcontract the services without the prior approval of the County. All work, whether initially funded or added to the contract because of additional funding, must be completed by February 28, 2023.
