The Town of Orange is requesting bids for the rental of trucks (including drivers) for its 2022-2023 winter snow removal program. 1.2 Bidders are required to comply with the instructions contained in these General Conditions and Specifications, and to provided information where requested. Bids must be made upon the forms contained herein. Ditto marks are not considered writing; shall not be used; and can be reason for non-acceptance of a bid. 3.3 All bids must be submitted in a sealed envelope, clearly marked "Snow Plowing" and received in the Public Works Office by the time of the bid opening defined in section 2.2 above. Bids, corrections and/or modifications, received after Town officials open the first bid, will not be accepted. 3.4 The bid form must be signed by an authorized agent of the submitting company. 3.5 All information submitted, must be in ink or typewritten. Mistakes may be crossed out and corrections inserted. Corrections must be initialled by the person signing the bid form. 3.6 The inability to meet any specified requirement(s) shall be (a) stated in writing and attached to the bid form, or (b) written on the bid form At the time of opening the bids, bidders shall be presumed to have read, and be thoroughly familiar with all specifications in this document. Failure of any bidder to receive, or examine, any form, instruction or document, shall not relieve any bidder from obligations with respect to their bid. 3.8 The specifications listed are to be interpreted as meaning those acceptable to the Town of Orange. Substitutions that are "an approved equal," will be considered. 3.9 The completed Bid Package shall be in conformance with all other requirements as stated herein. 4.0 PAYMENT 4.1 The Town agrees that in consideration of the faithful performance by the successful bidders of all covenants and agreements contained herein, to pay the successful bidders, within thirty (30) calendar days from receipt of invoice. MISCELLANEOUS 5.1 Bidders may withdraw their bid any time prior to the time of bid opening. No bidder shall withdraw, cancel or modify their bid for a period of sixty (60) days after bid opening. 5.2 The Town of Orange is exempt from Connecticut Sales and Use Taxes and Federal Excise Taxes. 5.3 The Town of Orange reserves the right to: accept any, all or any part of bids; to waive any informalities; to take into account the residency and business location of bidders within the Town of Orange; and to award the bid deemed by the Town of Orange to be in its best interest. Lowest price shall not be the sole determining factor when awarding the bid. 5.4 The hourly price per vehicle inserted on the bid form shall be firm from the date of bid through April 30, 2023. Increases in that price shall not be accepted for any reason 5.5 All work performed by contractors shall be reviewed by the Orange Highway Department. Unsatisfactory performance, as determined by the authorized representative of the Town, may be grounds for termination of any contract resulting from theses specifications. Such authorized representative decision shall be final, and the contractor shall be paid for actual work done to the time of dismissal less any additional costs incurred by the Town for correcting deficiencies. 5.6 The vehicles of successful bidders shall be inspected at and by the Orange Highway Department, 308 Lambert Road, Orange, before any snow plowing is done. Discrepancies shall be corrected before any snow plowing is authorized. Failure to correct efficiencies shall result in default on the part of the contractor and cause for dismissal. The Town of Orange shall have the right to exercise its right to select the next qualified bidder and assess the defaulting contractor for any additional costs incurred. 5.7 Contractors' trucks must be equipped with auxiliary lights, chains if needed, snow tires with excellent tread, adjustable plow lights, flashing lights and a cellular phone, fully charged and continuously activated. Such cell phone numbers will be made known to the Highway Department "snow" dispatcher immediately upon reporting for work. 5.8 Contractors shall pay for their own repairs, fuel, insurance and taxes. Contractors must assign the same driver each time they are called out, except in the event of illness. Contractors shall have relief drivers available in the event of prolonged storm events. Contractors shall provide the Town with the name of the primary and relief drivers and their Connecticut Driver's License Numbers (CDL where applicable). 5.10 Contractors will each be assigned a designated route by the Town's authorized representative and their vehicles must be available November 1, 2022, through April 30, 2023. 5.11 Proof shall be provided to the Highway Crew Chief that each driver is part of a DOT-approved, drug and alcohol testing program. Failure to do so shall be grounds for not accepting any such driver and cancellation of the contract. 5.12 Trucks shall have a metal body of contractor's type; preferably two-axle; maximum weight of 28,000 pounds; under frame hoist and mouldboard; 11 foot preferred and minimum 10 foot complete, sanding equipment. The sanding unit shall be a hopper type with a minimum capacity of 5 1/2 cubic yards. TAIL GATE SANDERS ARE NOT PERMITTED.
