Upon the award of any public construction contract exceeding one hundred thousand dollars ($ 100, 000) to a prime contractor, such Contractor shall furnish to the City a 5% bid bond with its Bid Proposal and a 100% performance bond and a 100% payment bond if awarded the contract The Bidder understands that the City reserves the right to reject any or all bids, and to waive informalities and minor irregularities in bids received, in accordance with all applicable law. The City of Danville may deduct liquidated damages in the amount of one hundred dollars ($100.00) for each consecutive calendar day
