A licensed/permitted company to provide hazardous waste (HW) management, compliance, transport, and disposal services relating to commercially manufactured Electronic Nicotine Delivery System (ENDS) products. ENDS, commonly referred to as "vape", contain liquid nicotine (P075 acutely hazardous waste) and lithium-ion batteries (universal waste). Transportation and disposal services may be needed on short notice throughout the year, depending upon significant seizures and/or storage space limitations, and 2. In-person HW training for DOR personnel including basic handling, storage, packaging, and paperwork associated with the ENDS waste that complies with EPA and Mass DEP hazardous waste regulations. Please include the cost breakdown of applicable training in the proposal. Services to be provided include: 1. Setting up two (2) Hazardous Waste storage areas, including but not limited to required signage. 2. Contingency plan, if needed. 3. Providing key documents that CIB and MEB will need with respect to their respective HW storage areas and activities (e.g., weekly inspection logs, weekly inspection reports, etc.); and 4. Preparation of Biennial Report, if needed. It is anticipated that between at least two (2) and four (4) shipments will be scheduled throughout the year and the start date would be approximately September 15, 2022. The HW will be generated and stored at the DOR facility located at 200 Arlington Street, Chelsea, Massachusetts. DOR has applied for an EPA large quantity generator (LQG) ID for the facility. It is anticipated that a new DOR facility, to be located in the area of I-95 and I-90, will be secured for the storage of these hazardous materials within the year and all activities related to this contract will be transferred to the new location at that time. ENDS are generally described as commercially manufactured handheld battery-operated devices, whether disposable or reusable, that people use to inhale an aerosol. ENDS normally include a mouthpiece, cartridge (liquid storage area), heating element, microprocessor, battery (sometimes rechargeable), and an LED light indicator. The ENDS are normally packaged in small paper, cardboard, or plastic containers. The liquid used in ENDS is often referred to as "e-liquid" or "juice" and normally contains liquid nicotine, propylene glycol, glycerine, and flavourings. These are a few disposable items DOR is looking to have disposed with a visual listed underneath: ENDS disposable devices that contain liquid nicotine and lithium-ion batteries (Photo #1). ENDS re-usable devices that contain lithium-ion batteries, but no liquid nicotine (Photo #2) ENDS E-liquid or Juice Bottles/Pods (normally plastic) that contain liquid nicotine (Photos #3) Qualified vendor must demonstrate a strong safety and compliance record for all activities associated with the management, transportation, and/or disposal of the types of wastes covered by this RFR/SOQ. Provide a detailed description, organized chronologically, of all federal and state environmental regulatory compliance and/or enforcement actions exercised against the vendor, TSDF(s) and transporter(s) during the past three years and measures taken to resolve those actions. Also list any known pending enforcement actions. For vendors with multiple TSDF options, please provide information only for those facilities that will handle DOR materials. Vendors shall ensure the management, transportation and disposal of all materials covered by this RFR/SOW are performed in an appropriate, fully compliant, and responsible manner that is acceptable to DOR. Please provide information on the costs of management services, transportation, and disposal of these materials, labour rates and associated fees. Proposals submitted should include information that is specific to labour rates for a chemist, a driver and a helper as well as the vehicle rates, and each job estimate must include all applicable Prevailing Wage Rates. All invoicing should not exceed the proposed estimates, and the selected bidder must submit a certified payroll record prior to the Massachusetts Department of Revenue authorizing any payment for services. All bidders must provide a Service Price Breakdown sheet, and the submission of a Certificate of Insurance (COI) is required. Proposals should include references for HW services of similar scope and complexity within the past three to five years. All interested vendors are encouraged to submit quotes. All interested vendors are also encouraged to attend a brief walk-through of the DOR facility.
