Site work for a water / sewer project in Fresno, California. Completed plans call for site work for a water / sewer project.
For Construction of Stormwater Drainage Facilities . The project has been divided into two (2) construction phases. Phase 1 work comprises all work related to Fresno Irrigation District facilities and work that will affect the Fresno Irrigation District's ability to route water in Washington Colony Canal No. 15. Fresno Irrigation District's water deliveries are scheduled to begin no earlier than February 15, 2023. All work within Fresno Irrigation District's easement shall be included in Phase 1. This first Notice to Proceed will be issued within five (5) calendar days of the notification to the Contractor that an award of the Contract has been made, unless otherwise mutually agreed between the District and the successful bidder. The first Notice to Proceed will be issued no later than December 28, 2022. Cash, a cashier's check, certified check or bidder's bond, in the amount of not less than ten percent (10%) of the amount of the bid, shall accompany each proposal, made payable to the order of the Fresno Metropolitan Flood Control District, as a guarantee that the bidder will, after being notified of the acceptance of his bid, make a contract with the Fresno Metropolitan Flood Control District in accordance therewith, and will furnish the required contractor's bonds. The bonds required of the successful bidder are a faithful performance bond in the amount of one hundred ten percent (110%) of said bid and a payment bond in an amount equal to one hundred percent (100%) of the amount of said bid, in accordance with the provisions of Sections 3247-3251 of the California Civil Code. If the successful bidder fails to execute the contract for which the bid is accepted and fails to furnish the required bonds within ten (10) days after the mailing of notice of the award of the contract to the successful bidder, the Board of Directors shall have just cause for annulment of the award and forfeiture of the proposal guarantee. In this case, the Board of Directors reserves the right to award the contract to one of the other bidders or reject all bids. The Board of Directors reserves the right to reject any or all bids, to award or reject any combination of items as it sees fit, and to waive any informality in any bid received. The contract will be awarded to the lowest responsible bidder complying with these instructions and with the advertised Notice to Contractors inviting bids. The Fresno Metropolitan Flood Control District, however, reserves the right to reject any or all bids, or to waive any or all bids, or to waive any informality in a bid. The fact that the District may have awarded the contract pursuant to a waiver of irregularity by the successful bidder shall not excuse forfeiture of the proposal guaranty in the event the bidder refuses to execute the contract. As noted above, a separate Notice to Proceed will be issued for Phase 1 and Phase 2 work. Each phase of work will be treated as a separate entity with its own Notice to Proceed, allowed time for completion, final acceptance and liquidated damages. The Contractor shall pay to the District for liquidated damages the sum of five hundred dollars ($500.00) per day for each and every calendar day of delay in completing the total work under this contract or for delay in completing the portion of the work specified within the time limits set forth herein. The Contractor shall also pay to the County of Fresno any liquidated damages required per the attached County of Fresno "Dummy Permit" located in the Appendix of these Special Provisions . Reference is made to Section 4 of these Special Provisions for the liquidated damages associated with this bid item.
