CITY OF DEER PARK REQUEST FOR ENGINEERING SERVICES The City of Deer Park is requesting Statements of Qualifications from consulting engineering firms to provide the City engineering services with respect to tasks such as project plan preparation and specifications, construction management services and other tasks identified with projects planned and identified below for the period 2023-2027. Work to be done will include: o WATER PROJECTS - Engineering, Design, Inspection and Testing of projects including but not limited to: Water Comprehensive Planning Updates, drinking water supply wells and booster pump stations, water main installations, water rights consolidations and acquisitions, water reservoir planning and design/construction, on Airport and Industrial areas water distribution infrastructure, GIS Water Infrastructure system mapping and updates. o WASTEWATER PROJECTS - Engineering, Design, Inspection and Testing of projects including but not limited to: wastewater primary treatment system improvements and modifications, land application evaluations, utility main upgrades and expansions, pump station upgrades, Wastewater Comprehensive Planning Updates and on Airport and Industrial areas wastewater collection and pump station infrastructure, GIS Wastewater Infrastructure system mapping and updates. o STREET PROJECTS - Engineering, Design, Inspection and Testing of projects including but not limited to: N. Colville Avenue widening and reconstruction, S. Fir Avenue widening and reconstruction, W. Fourth Street reconstruction, North Airport Road widening and reconstruction, S. Weber Road widening and reconstruction, Federal Aid Route preservation projects, on Airport paved service roads and vehicle parking areas. o AIRPORT PROJECTS - Engineering, Design, Inspection and Testing of projects including but not limited to: Runway Mag/Var change, taxilane reconstruction, pavement maintenance to include: crack routing and sealing fog sealing and marking, airport lighting and signage, snow removal equipment building design and construction, taxilane design and construction, land survey and documentation.. o PARKS AND RECREATION - Engineering, Design, Inspection and Testing of projects including but not limited to: Perrins Field Park reconfiguration, Park expansions and improvements to Mix Park and other parks within the city, municipal swimming pool construction / renovations including splash pad development, Sports Complex expansions and upgrades. o ADDITIONAL SERVICES - Comprehensive Plan Update, Planning, Design, Consultation services for projects identified for compliance with the Growth Management Act and plan reviews and construction observation services associated with various engineering components relative to developer generated construction documents for subdivisions and developments. Qualified firms are invited to submit a proposal in the format outlined in the Request for Proposal (RFP) packet. BUY AMERICAN PREFERENCE The Contractor agrees to comply with 49 USC 50101, which provide that Federal funds may not be obligated unless all steel and manufactured goods used in AIP funded projects are produced in the United States, unless the FAA or other Federal agency has issued a waiver for the product, the product is listed as an Excepted Article, Material or Supply in Federal Acquisition Regulation subpart 25.108; or is included in the FAA Nationwide Buy American Waivers Issued list. A bidder or offer must complete and submit the Buy American certification with their bid or offer. The Owner will reject as nonresponsive any bid or offer that does not include a completed Certificate of Buy American Compliance. CERTIFICATION OF OFFERER/BIDDER REGARDING DEBARMENT By submitting a bid/proposal under this solicitation, the bidder or offeror certifies that neither it nor its principals are presently debarred or suspended by any Federal department or agency from participation in this transaction. FAIR LABOR All contracts and subcontracts that result from this solicitation incorporate by reference the provisions of 29 CFR Part 201, the Federal Fair Labor Standards Act (FLSA), with the same force and effect as if given in full text. The FLSA sets minimum wage, overtime pay, recordkeeping, and child labor standards for full and part-time workers. The Consultant has full responsibility to monitor compliance to the referenced statute or regulation. The Consultant must address any claims or disputes that arise from this requirement directly with the U.S. Department of Labor - Wage and Hour Division. TRADE RESTRICTION CERTIFICATION By submission of an offer, the Offeror certifies that with respect to this solicitation and any resultant contract, the Offeror: 1) is not owned or controlled by one or more citizens of a foreign country included in the list of countries that discriminate against U.S. firms as prohibited by the Office of the United States Trade Representative (USTR); 2) has not knowingly entered into any contract or subcontract for this project with a person that is a citizen or national of a foreign country included on the list of countries that discriminate against U.S. firms as published by the USTR; and 3) has not entered into any subcontract for any product to be used on a Federal project that is produced in a foreign country included on the list of countries that discriminate against U.S. firms published by the USTR. This certification concerns a matter within the jurisdiction of an agency of the United States of America and the making of a false, fictitious, or fraudulent certification may render the maker subject to prosecution under Title 18 USC Section 1001. The Offer/contractor must provide immediate written notification to the City if the Officer/Contractor learns that its certification or that of a subcontractor was erroneous when submitted or has become erroneous by reason of changed circumstances. The Contractor must require subcontractors provide immediate written notice to the Contractor if at any time it learns that its certification was erroneous by reason of changed circumstances. Unless the restrictions of this clause are waived by the Secretary of Transportation or other Federal agency in accordance with 49 CFR 30.17, no contract shall be awarded to an Offeror or subcontractor: 1) who is owned or controlled by one or more citizens or nationals of a foreign country included on the list of countries that discriminate against U.S. firms published by the USTR, or; 2) whose subcontractors are owned or controlled by one or more citizens or nationals of a foreign country on such USTR list, or; 3) who incorporates in the public works project any product of a foreign country on such USTR list. Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by the provision. The knowledge and information of a contractor is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings. The Offeror agrees that, if awarded a contract resulting from this solicitation, it will incorporate this provision for certification without modification in all lower tier subcontracts. The Contractor may rely on the certification of a prospective subcontractor that it is not a firm from a foreign country included on the list of countries that discriminate against U.S. firms as published by USTR, unless the Offeror has knowledge that the certification is erroneous. NONDISCRIMINATION STATEMENT The City of Deer Park in accordance with Section 504 of the Rehabilitation Act (Section 504) and the American with Disabilities Act (ADA), commits to nondiscrimination on the basis of disability, in all or its programs or activities. TITLE VI STATEMENT The City of Deer Park in accordance with Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42 U.S.C. 2000d-4 and the Regulations, hereby notifies all bidders that is will affirmatively ensure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, national origin in consideration for an award. In determining the best qualified firm, the City will consider all acceptable proposals based on the proposal provided consistent with the RFP requirements. The City of Deer Park reserves the right to reject any and all proposals, to waive any irregularities in the proposal received and to accept the proposal that is in the best interest of the City. The City published this request in accordance with the requirements of RCW39.80. Contracts with selected firms will be negotiated in accordance with RCW 39.80.
