Under this contract, the CONTRACTOR shall furnish all materials, equipment, supplies, and labor required for the improvements specified herein and shown on the Contract Drawings. All Project inquires shall be directed to Tract Engineering, PLLC, Attn: Tim Gourley, PE, 120 Ridge Avenue, State College, PA 16803; 814-272-0301; tg@tractllc.com. A certified check, payable to the OWNER, or satisfactory BID BOND executed by the BIDDER and SURETY COMPANY, in an amount equal to ten (10%) percent of the total amount bid, shall be submitted with each bid. All SURETY COMPANIES executing bonds must appear on the Treasury Departments most current list (Circular 570 as amended) and be authorized to transact business in Pennsylvania. No BIDDER may withdraw a bid within sixty (60) days after the actual date of the opening thereof. Should there be reasons why the contract cannot be awarded within the specified period; the time may be extended by mutual agreement between the OWNER and BIDDER. The successful BIDDER will be required to furnish satisfactory Performance and Labor and Material Payment Bonds for 100% of the contract price. The OWNER reserves the right to accept or reject any or all bids. The successful BIDDER will be required to fully complete all work by the completion date provided in the Project Manual. Work under the Contract is subject to the requirements of Executive Order #11246, as amended, regarding Equal Opportunities as outlined in the Project Manual. All BIDDERS will be required to comply with the Contract Compliance Regulations of the Pennsylvania Human Relations Commission, 16 PA Code Chapter 49 and with all laws prohibiting discrimination in hiring or employment opportunities. The Contract also includes a nondiscrimination clause.
