Construction of a 6-inch waterline along the northern right of way of State Highway 31 W including gate valves, fire hydrant assemblies, connections to existing waterlines, and associated waterline appurtenances. 1.3 CONTRACTOR USE OF SITE AND PREMISES A. Limit use of site and premises to allow: 1. Owner occupancy and operation of water system. 2. Work by others and work by Owner. B. The Contractor shall be responsible for any and all damages caused by the Contractors activities whether within the designated right-of-ways or private property. The percentages for minority participation 22.5 The female employment goal is effective as of April 1980 and is currently 6.9% For Highway 31 W Waterline Extension associated with the American Rescue Plan Act - Coronavirus Local Fiscal Recovery Fund (ARPA - CLFRF) allocation Bids are invited for several items and quantities of work as follows: Construction of a 6-inch waterline along the northern right of way of State Highway 31 W including gate valves, fire hydrant assemblies, connections to existing waterlines, and associated waterline appurtenances. A bid bond in the amount of 5 percent of the bid issued by an acceptable surety shall be submitted with each bid (for those contracts that exceed $100,000). A certified check or bank draft payable to the City of Malakoff or negotiable U.S. Government Bonds (as par value) may be submitted in lieu of the Bid Bond. Attention is called to the fact that not less than, the federally determined prevailing (Davis-Bacon and Related Acts) wage rate, as associated with the ARPA-CLFRF and contained in the contract documents, must be paid on this project. In addition, the successful bidder must ensure that employees and applicants for employment are not discriminated against because of race, color, religion, sex, sexual identity, gender identity, or national origin. The City of Malakoff reserves the right to reject any or all bids or to waive any informalities in the bidding. The City Council may award the bid that presents the best value for the City pursuant to Gov't Code Section 2269.055 using the criteria set forth herein. In determining best value for the City, the City Council shall consider: (1) the price; (2) the reputation and experience of the Contractor; (3) the quality of the Contractor's services; (4) the impact on the ability of the City to comply with rules relating to historically underutilized businesses; (5) the Contractor's safety record; (6) the Contractor's proposed personnel; (7) whether the Contractor's financial capability is appropriate to the size and scope of the project; and (8) the Contractor's past relationship with the City Bids may be held by the City of Malakoff for a period not to exceed 60 days from the date of the bid opening for the purpose of reviewing the bids and investigating the bidder's qualifications prior to the contract award.
