Proposals from prospective Contractors not attending, or who are not present for the entire pre-proposal conference site visit will not be considered for award. As used in this agreement, the following terms shall have the meanings indicated below: Section 2.01 UNIVERSITY: "University" shall mean, The University of North Carolina at Chapel Hill for its Carolina Housing Department. Section 2.02 OFFEROR: "Offer or" shall mean a company/firm submitting a proposal in response to this Request for Proposals. Section 2.03 CONTRACTOR: "Contractor" shall mean the Contractor that will provide the professional services for the University. Section 2.04 TERM: "Term" shall refer to the length of time the contract will be valid. Section 2.05 CONTRACT ADMINISTRATOR: "Contract Administrator" shall mean the University representative who shall be the direct liaison between the Contractor and the University for this contract. That representative will be Lynn Barello. Section 2.06 UNIVERSITY HOLIDAY SCHEDULE: The University's Holiday Schedule is maintained at website. The Contractor hereby agrees to work directly with the University, or its designated Contract Administrator, in connection with carrying out and conducting all of the following duties and responsibilities during the term of this agreement. Section 3.01 The Contractor shall repair and/or replace carpet and vinyl flooring systems as required by the University. Work will be identified on an as-required basis. Section 3.02 The Contractor shall provide all materials, equipment, and personnel to complete the required work. During the May - August time period, as many as 20 apartments may require work within a one week time period. The contractor shall have sufficient resources to meet this requirement. Section 3.03 The Contractor shall respond to and complete individual work requests within 5 calendar days unless a different completion date is agreed upon at the time of scheduling the work. Every effort will be made to provide as much advance notice as possible. Section 3.04 The Contractor shall be responsible for measuring the work areas and providing a cost estimate for the work in advance, if requested. Section 3.05 The Contractor shall, at the completion of work, ensure that work areas are returned to the condition that they were in prior to the commencement of work. This includes returning furniture to its original location. Furniture will be moved properly and protected from damage. Any damage that occurs to University or personal furniture, equipment, or other items are the responsibility of the contractor to repair or replace. Section 3.06 All vehicles shall be clearly identified as belonging to the Contractor and shall clearly display UNCCH parking permits. Parking permits are the responsibility of the Contractor and can be purchased and obtained by contacting the Office of Public Safety at 962-3951. Section 3.07 The Contractor shall be responsible for the proper off-site disposal of any and all trash of any kind and shall recycle any materials they can. Section 3.08 The Contractor's employees shall be of high integrity and character. Any of the Contractor's supervisors or employees whose behaviour or language is offensive, harassing or intimidating to any University employee, student or resident shall be asked to leave the University premises immediately and shall be restricted from working further on University premises. Verbal requests to leave the University premises shall be followed by written requests provided to the Contractor's supervisor by the close of the following business day. Section 3.09 The Contractor shall report any destruction, loss of or damage to any University property within 24 hours of the loss or damage. The report shall be provided to the Contract Administrator in writing and shall specify the type, location and extent of the loss or damage. Failure to report any destruction, loss or damage may be construed as default of the contract and, if so determined, will be handled in accordance with Section 7.06. Section 3.10 The Contractor shall be required to conduct extensive criminal checks on all employees and provide a copy to the Contract Administrator. This will apply to any new employees hired after the contract has been awarded. Section 3.11 The Contractor shall be responsible for off-site storage of all materials. Section 3.12 The Contractor shall be responsible for quality control to include supervisor or management inspection of all completed work. Section 3.13 The Contractor shall be responsible for completing work only within the approved timeframe of Monday through Friday, 8 a.m. to 5 p.m., and excluding any University holidays. Section 3.14 The Contractor shall be responsible for following all applicable University policies and procedures including parking regulations and smoke free polices. All proposals are subject to the terms and conditions outlined herein. All responses shall be controlled by such terms and conditions and the submission of other terms and conditions and other documents as part of an Offer or response will be waived and have no effect either on this RFP or any contract that may be awarded resulting from this solicitation. The submission of any other terms and conditions by an Offer or may be grounds for rejection of the Offertory's proposal. Offer or specifically agrees to the conditions set forth in this paragraph by the signature of its authorized representative on the execution of the proposal page contained herein. Qualified firms are encouraged to submit a proposal for performing the services described herein. All proposals must be submitted strictly in accordance with the requirements of this RFP. Failure to include any required information in the proposal may disqualify an Offer or as a potential Contractor. Proposals shall be prepared simply and succinctly providing a straightforward, concise description of the Offer or abilities to satisfy the requirements of this RFP. Emphasis shall be on completeness and clarity of content. The information shall be prepared, tabbed and submitted in the order given below. The proposal shall be of sufficient detail to describe the following TECHNICAL PROPOSAL A. The Offer or shall provide documentation that they have been in the flooring business at least five (5) years. B. The Offeror shall provide the names of current employees who shall provide the installation services, years of service with the Contractor and dates of any certifications or manufactures training certificates. C. The Offeror shall list a minimum of three (3) references, including point of contact, phone number and address. D. The Offeror shall provide copies of insurance certificates with respect to each of the insurance policies to be maintained in compliance with the provisions of Article V. E. The Offeror shall provide a signed copy of the Execution of Proposal page with the technical proposal. The Execution of Proposal page is located directly after Article VII, Terms and Conditions. F. The Offeror shall provide a completed copy of the WHERE SERVICE CONTRACTS WILL BE PERFORMED page with the technical proposal.
