Each Proposal shall be accompanied by an acceptable form of Proposal Guaranty in an amount equal to at least 5% of the amount of the Proposal payable to Comanche County Rural Water District #3 as a guaranty that if the Proposal is accepted, the BIDDER will execute the Contract and file acceptable Performance and Statutory Bonds within 10 days after the award of the Contract. Comanche County Rural Water District #3 hereinafter called the OWNER, reserves the right to reject any or all Proposals and to waive any formality or technicality in any Proposal in the interest of the OWNER. Liquidated damages for failure to complete the work within the time specified shall be assessed at the rate of $250 per day for each additional calendar day until the work is completed.
