The following are PREREQUISITES TO BE RETURNED NOTARIZED WITH SEAL AND SIGNATURE with your bid response. Failure to provide all the following may disqualify the Bidder: 1. Original and one copy of proposal 2. Non-Collusion Affidavit 3. Equal Employment Opportunity Response Sheet 4. Stockholder Disclosure Requirement 5. Disclosure of Investment Activities in Iran 6. New Jersey Business Registration Certificate 7. Public Works Contractor Registration Certificate 8. Consent of Surety, Bid Security 9. Prequalification form State of New Jersey, Department of Treasury, Division of Property Management and Construction 10. State of New Jersey, Division of Property Management and Construction DPMC 701 Form (Total Amount of Uncompleted Contracts) All bidders are hereby notified that compliance with the New Jersey Prevailing Wage Act (Chapter 150, Laws of 1963) and pursuant to N.J.A.C. 12:60-2.1 6.1 effective March 1, 1992 and with the rules and regulations of any public agency and/or department, applicable to projects in which said department participates, will be required in the performance of any contract awarded. The successful bidder must provide "certified copies" of all applicable "Payroll Records" to the Authority for each payroll period during the term of this award. These records will be made available for inspection to all interested parties. A Corporation of the State of New Jersey, submitting a bid in response to the Advertisement, shall, if successful, provide a resolution authorizing its proper officers to execute a contract. A stockholder disclosure is required to be submitted with the bid listing all stockholders holding more than Ten Percent (10%) of the Corporate Stock. Bidders must comply with P.L. 2004, c. 57, Business Registration Act, as amended. Bidders must comply with P.L. 1999, c. 238, The Public Works Contractors Registration Act, as amended. A certificate from a surety company will be required to be submitted with the bid as per N.J.S.A 18A:64A-25.17 as amended stating that it will provide the Performance/Payment bond required by the bid documents if the bidder is awarded the total bid or any part thereof. THE SURETY COMPANY MUST INDICATE IN ITS CERTIFICATE THAT IT IS LICENSED TO TRANSACT BUSINESS IN THE STATE OF NEW JERSEY. Each bidder must deposit with their bid, security in an amount of not less than ten percent (10%) of the Base Bid, but not to exceed $20,000.00, and subject to the conditions provided in Instructions to Bidders. The successful bidder will be required to furnish a Performance/Payment bond in the full amount of the contract price indemnifying the Owner from any and all proceedings, suit or actions of any kind, name, or description and conditional for the faithful performance of the work and as security for the payment of all persons performing labor and furnishing materials in connection with the contract. Each bidder shall submit with their bid, an affidavit showing prequalification in accordance with the standards by the State of New Jersey, Department of Treasury, Division of Property Management and Construction. The prequalification standards are accepted as meeting the minimum requirements of prequalification certification by the above State Agency for bidders. Each bidder shall therefore attach to their bid the prequalification certification from the above referenced State Agency which must be active on the date of acceptance of these bids. Failure to do so will be cause to reject the bid as being non-responsive. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 and N.J.A.C. 17:27. No bidder may withdraw their bid for a period of sixty (60) days after the actual date of the opening thereof. The Owner reserves the right to select any combination of bids or to award the contract in part or whole and to waive any informalities in or to reject any and all bids if deemed to the best interest of the Owner to do so.
