The Bidder has visited the site and become familiar with conditions under which the Work is to be performed and has correlated the project requirements indicated in the Contract Documents, including Drawings and Specifications, with Bidder's on-site observations. Questions regarding the bid must be submitted in writing by Monday, November 14th @ 4:30PM, 2022 to: Dustin Kruger / Wanda Kane Dkruger@co.scott.mn.us / wkane@co.scott.mn.us Written responses to all questions received will be furnished by Wednesday, November 16th @ 4:30pm via the Scott County website electronically. If a Bidder is unable to access the information via the website, a written request may be submitted as set out herein to have the responses sent in written form. No oral questions will be entertained at any time. Bidders are cautioned not to contact any Owner staff directly; responses will be provided via bidding website. Evidence of such contact may be cause for rejection of bid responses. A. Bidders requiring interpretations of the Bidding Documents shall make a written request to the Architect at least 5-days prior to date for receipt of Bids. B. Interpretations and clarifications of the Bidding Documents will be made by Addendum. Substitutions will not be considered prior to receipt of bids unless written request for approval has been received by the Architect at least ten days prior to the date for receipt of bids. The burden of proof of the merit of the proposed substitution is upon the proposer. The Architects approval or rejection of a proposed substitution shall be final. A. Each Bid shall be accompanied by a bid security in the form and amount required when indicated. Bidder pledges to enter into a Contract with Owner on the terms stated in the Bid and will, if required, furnish bonds covering the faithful performance of the Contract and payment of all obligations arising under the Contract. B. Owner will have the right to retain the bid security of Bidders to whom an award is being considered under the following conditions: 1. The Contract has been executed and bonds, if required, have been furnished. 2. The specified time has elapsed so that Bids may be withdrawn. 3. All Bids have been rejected. Late bids will not be accepted and will be returned to the vendor unopened. Bids received prior to the time of opening will be kept secured and unopened. The officer whose duty it is to open the bids shall determine when the specified time has arrived. No bid received thereafter will be considered and will be returned to the bidder unopened. A Bid may not be modified, withdrawn or canceled by the Bidder during the time period following the time and date of the receipt of Bids. Prior to the time and date designated for receipt of Bids, a Bid submitted may be modified or withdrawn by notice to the party receiving Bids at the place designated for receipt of Bids. Such notice shall be in writing over the signature of the Bidder. A. Furnish bonds covering faithful performance of the Contract and payment of all obligations arising under the Contract. 1. Form: AIA Document A 312-2010 Performance Bond and Payment Bond. B. Furnish bonds prior to the execution of the Contract. Add the cost of the bonds to the Bid to determine the total Contract Sum.
