All bids and proposals shall be properly and completely executed in accordance with the specifications on Form 96, including a non-collusion affidavit, as required by Indiana law and must comply with the General Bid Requirements, including without limitation, must contain a completed Bidder's Skatepark Qualifications form. The bid envelope must be sealed and have the words "Skatepark Expansion" on the exterior bid bond or certified check in an amount of not less than ten percent (10%) of the amount bid must be submitted. A payment bond and performance bond in the amount of one hundred percent (100%) of the contract price will be required by the successful bidder. It is anticipated that actual construction of the work will commence as soon as practical and each bidder shall be prepared to promptly enter into a Construction Contract in the form provided with the specifications, furnish a performance bond and payment bond and commence work without delay in the event the contract is awarded to the bidder. Each bidder shall be responsible for ensuring that it has obtained a complete set of specifications and other contract documents and shall assume the risk of any errors or omissions in bids prepared in reliance on incomplete sets of plans, specifications, drawings and other documents. All bidders must comply with the provisions of Indiana Code 5-16- 13 and all other provisions of applicable law. The Park Board reserves the right to hold any and all bids or proposals for a period of not more than sixty (60) days and said bids or proposals shall remain in full force and effect during such period. The Park Board reserves the right to waive any minor informality, irregularity or omission in any bid and to reject or cancel any and all bids, solicitations or proposals as provided by Indiana Code 36-1- 12-4.
