Design and Construction Services (Design-Build) for Indoor Air Quality (IAQ) Improvements and Microgrid at Compton Unified School District Prequalification of Prospective Bidders ENGIE has determined that bidders who submit bids on the above referenced project must be prequalified. Required Licensure ENGIE is seeking to prequalify Tier 1 subcontractors with the following licenses: C-10 and C-20 licenses that intend to bid as a subcontractor(s) directly to ENGIE. Completion of Prequalification Application Interested parties are required to respond to the materials fully and completely in the Prequalification Application available upon request via email to Steven Cacace at steve.cacace@engie.com. Any prospective bidder who does not submit the required information using the Prequalification Application and /or any attempt to use an alternative form by a bidder shall be disregarded. All requested information in the Prequalification Application must be appropriately filled in and all required documents and attachments must be provided. ENGIE reserves the right to reject any Prequalification Application if all the information is not furnished by the bidder. It is each bidder s sole responsibility to ensure its Prequalification Application is completed without blanks, omissions, partial omissions, unanswered portions, and/or partially unanswered portions. It is each bidder s sole responsibility to ensure its Prequalification Application is electronically to Engie by email at or before the time specified in the Prequalification Application. It is each bidder s sole responsibility to ensure its Prequalification Application is electronically received by Engie via email as specified in the Prequalification Application. Failure to meet the above noted requirements will be considered non-responsive and the Prequalification Application will be rejected. All Prequalification Applications shall be completed by the date and time set forth above. Any interested party is solely responsible for ensuring its prequalification application is completed by the deadline set forth above and is fully complete and responsive. ENGIE shall not be responsible for any delays or errors in submission. All interested parties must take all steps necessary to ensure their Prequalification Application is completed in a timely manner and delivered to ENGIE. Prequalification to bid on the project listed is required irrespective of, and in addition to, any prequalification for any other ENGIE or District work already on file. ENGIE reserves the right to reject any (or all) responses to the Prequalification Application and to waive any non-material irregularities in any response received. Upon completing its review of the responsive Prequalification Applications, Engie will determine up to Subsequently, Engie will award the work among the qualified subcontractors based on best value . References Each firm must provide contractor project references as specified in the Prequalification Application. Applicants shall include project references for California K-12 Public School projects the Firm has participated as a contractor or first tier subcontractor over the past ten (10) years of more than ENGIE will make efforts to contact and receive responses from the Bidder s references within five (5) business days of the bidder submitting the Prequalification Application. To the extent the identified references fail to respond within this five (5) day period, ENGIE has the right to determine that the references identified by the bidder are not responsive, do not constitute a passing score, and constitute grounds for denial of pre-qualification not the bidder. Brief Description of the Project The project includes, but is not limited to, the following: Design, build, and construction of ventilation improvements, upgrades, and replacements at 17 sites. New HVAC systems for various rooms districtwide. New resilient battery energy storage microgrid system at one site. Local Participation This solicitation will assign preference points for subcontractors who have previously successfully completed project(s), for the Compton Unified School District. This solicitation will also assign preference points for subcontractors who have previously successfully completed projects with ENGIE. Labor Compliance Requirements All subcontractors must comply with all applicable labor compliance requirements under the California Labor Code, including but not limited to registration with the Department of Industrial Relations (Labor Code Sections 1771.1(a) and 1725.5), 1771, 1771.4, 1773.2, 1774, 1776, 1777.5, 1813, 1815. SB 854- Department of Industrial Relations SB 854 (Stat. 2014, chapter 28) made several changes to the laws governing how the Department of Industrial Relations (DIR) monitors compliance with prevailing wage requirements on public works projects. Prevailing wage applies to project over $1,00,000. Pursuant to California Labor Code Section 1771.1(a), as amended by SB 854, a contractor may not bid, nor be listed as a subcontractor, for any bid proposal submitted for public work or engage in the performance of any contract for public work unless registered and qualified to perform public work pursuant to Labor Code Section 1725.5, subject to limited legal exceptions. Section 1771.1(a) states as follows: A contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, subject to the requirements of section 4104 of the Public Contract Code, or engage in the performance of any contract for public work, as defined in this chapter, unless currently registered and qualified to perform public work pursuant to Section 1725.5 it is not a violation of this section for an unregistered contractor to submit a bid that is authorized by Section 7029.1 of the Business & Professions Code or by Section 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded. As a result, no contractor or subcontractor may be listed on a bid proposal for a public works project unless registered with DIR. To comply with the DIR guidelines, ENGIE will disqualify any contractor (and subcontractor) who is not registered with the DIR at the time the bid (or prequalification) package is opened, the award will go to the next low responsible bidder who is registered with the DIR. All contractors and subcontractors must furnish electronic certified payroll records directly to the Labor Commissioner (aka Division of Labor Standards Enforcement). This project will be subject to compliance monitoring and enforcement by the DIR, pursuant to California Labor Code Section 1771.4. In addition to submitting certified payroll records directly to the Labor Commissioner, the awarded contractor must also provide one original set of certified payroll records to ENGIE s Labor Compliance Department.
