Lincoln Electric System is requesting bids to furnish and deliver FOB, Lincoln, Nebraska the listed Elbows & Fuses as per LES Bid description included in this bid solicitation. Question Deadline 11/29/2022 at 4:00 PM CT Communications and technical questions concerning this Bid shall be submitted using the LES Electronically Each bid must include the full name and business address of the bidder and be legibly signed by the bidder. A bid by a firm or organization other than a corporation must include the name and address of each member. A bid by a corporation must be signed in the name of such corporation by an official authorized by the corporation to sign the bid. Any person signing a bid for a firm, corporation, or other organization may be required to show evidence of his/her authority to bind the firm, corporation, or organization. Each bidder shall submit as a part of the bid complete specifications and descriptive matter describing the work to be performed and a description of the equipment or other merchandise he/she proposes to furnish, including in the description such items as design, form, capacity, principles of operation, details of construction, materials used, workmanship, and guarantees of performance. The specifications and descriptive matter not in conflict with LES specifications shall be considered part of the conditions of the offer submitted by the bidder. LES may, in its sole discretion, reject any or all bids, or waive minor defects, irregularities, or informalities therein. All bids for the sale of equipment or merchandise shall be based upon the vendor delivering the equipment or merchandise to LES, at the location specified by LES, and with all transportation charges to be paid by the vendor awarded the bid. Each bidder shall state in their bid the date upon which they can make delivery of all equipment or other merchandise bid. The time required for such delivery is hereby made an essential element of the contract. Unless LES specifications provide otherwise, each bidder shall guarantee in their bid any new or used equipment or other merchandise to be furnished against mechanical and physical defects for a period of time to be stated by the bidder, dating from the date of delivery of the equipment or merchandise to LES, and to replace without charge any parts or portions of the equipment proven defective under ordinary service during such period. If the bidder fails to include any guarantees in the bid, the bidder shall be considered to be a merchant giving an implied warranty under Section 2-314 and section 2-315 of Nebraska's Uniform Commercial Code. Any implied warranty shall not, however, modify any express warranty arising from the submission or acceptance of any plans or specifications made a part of the bid. All bids should be submitted without computation of the amount owing by LES with respect to sales, use or other excise taxes. If the bid is made only with respect to the delivery of equipment or merchandise by the bidder, payment in full will be made by LES no later than thirty days after receipt of the equipment or other merchandise, after testshave shown that the equipment or merchandise complies with the specifications provided. The successful bidder shall pay all royalties and license fees and shall defend at its own cost all suits or claims for infringements of any patent rights, shall pay all awards of damages and all settlement agreements, and shall indemnify and save LES harmless from any loss on account of any such infringement, suit, or claim. Bids received after the time and date established for receiving bids will be rejected. Any escalator clause or any qualification price condition which makes it possible to bill at a price higher than price quoted must be detailed in the proposal. The escalator clause or condition will be used in comparison of bids. The successful bidder and their subcontractors shall not discriminate against any employee or applicant for employment, to be employed in the performance of the contract, with respect to hire, tenure, terms, conditions, or privileges of employment, because of race, color, religion, sex, age or national origin. The successful bidder shall comply with all laws and regulations enacted and promulgated by the United States, the State of Nebraska and any political subdivision thereof which govern the conduct of the Contractor during the performance of its obligations under the contract entered. LES shall not incur any liability for any costs incurred by vendors in replying to this solicitation, including any activity related to responding on this solicitation.
