A bid bond shall be (a) with a surety company qualified to do business in the Commonwealth of Massachusetts and satisfactory to the Authority, and (b) conditioned upon the faithful performance by the principal of the agreements contained in the bid. The bid deposit shall be in the amount specified in the request for Bids. Bid deposits of the three lowest bidders will be returned upon the issuance of the purchase order. Bid deposits of all other bidders will be returned within 15 days of the bid opening date. This bid constitutes a firm offer which may be accepted by the Authority within ninety (90) days from the bid opening date. If any product is found that does not meet the analysis submitted by the bidder in his/her proposal, the representative of the Authority may, at his/her option, exercise his/her right to reject the product and require that all or any part thereof shall be removed promptly by and at the expense of the contractor and replace it forthwith with a product satisfactory to the Authoritys representative, or to retain the product and compensate the contractor in an amount determined by the Authority representative.
