Site work for a water / sewer project in Garden City, Kansas. Completed plans call for site work for a water / sewer project.

For the construction of the Waterline Replacement Project The Project is generally described as a water system improvement project as follows: Waterline Replacement: Work includes the installation of city provided materials, all the labor and equipment for the utility improvements. The improvements include approximately 178 linear feet of 24- inch water piping; 24 DIP fittings with thrust blocking; Furnish and install one 24 line stop; site clearing and restoration, removal and replacement of surfacing, construction staking, mobilization, erosion control, grass seeding, and all other incidental and appurtenant work required to complete the improvements as shown and specified. Each bid shall be accompanied by a bid security in the amount of five percent (5%) of the total bid. No bidder may withdraw his bid as stated in the Project Manual. The City reserves the right to reject any or all bids, to waive informalities, and to accept the bid deemed to be in the best interest of the City. Contractors, subcontractors, suppliers, etc. must register or log-in to view and/or download Bidding Documents. Complete sets of Bidding Documents must be used in preparing Bids; neither OWNER nor ENGINEER assumes any responsibility for errors or misinterpretations resulting from the use of incomplete sets of Bidding Documents. The Work will be substantially completed by March 1, 2023 as provided in Paragraph 4.01 of the General Conditions when the contract times commence, and completed and ready for final payment in accordance with Paragraph 15.06 of the General Conditions by March 15, 2023. Contractor and Owner recognize that time is of the essence as stated in Paragraph 4.01 above and that Owner will suffer financial and other losses if the Work is not completed and Milestones not achieved within the times specified in Paragraph 4.02 above, plus any extensions thereof allowed in accordance with the Contract. The parties also recognize the delays, expense, and difficulties involved in proving in a legal or arbitration proceeding the actual loss suffered by Owner if the Work is not completed on time. Accordingly, instead of requiring any such proof, Owner and Contractor agree that as liquidated damages for delay (but not as a penalty): 1. Substantial Completion: Contractor shall pay Owner $500.00 for each day that expires after the time (as duly adjusted pursuant to the Contract) specified in Paragraph 4.02.A above for Substantial Completion until the Work is substantially complete. a. Contractor will have a 12 hour time frame to complete the proposed waterline "tie in". The time frame will start once the proposed line stop is closed isolating the 24" waterline (see specification section 01010 for a construction sequence.) A 4 hour grace period will be allowed after the initial 12 hours if necessary. A $150 per hour charge will be assessed once the initial 12 hour time frame and the 4 hour grace period have expired if the proposed waterline tie in is not complete and the 24" waterline is not back in service. 2. Completion of Remaining Work: After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining Work within the Contract Time (as duly adjusted pursuant to the Contract) for completion and readiness for final payment, Contractor shall pay Owner $500.00 for each day that expires after such time until the Work is completed and ready for final payment. 3. Liquidated damages for failing to timely attain Substantial Completion and final completion are not additive and will not be imposed concurrently.
